A man died while not praying and he has an estate; is it distributed to his sons?

Machine translationRead the Arabic original
The questioner : A man died while not praying and he has an inheritance; is this inheritance distributed to his sons?

The Shaykh : This question can be answered in light of the previous answer regarding the question of the brother there about the one who abandons prayer, and whether the Companions differed on the disbelief of the one who abandons prayer. In brief, the answer is a summary of the previous discussion: if this man was known to deny prayer and mock those who pray, then he is a disbeliever, and he is not buried in the Muslim cemeteries, nor does he leave an inheritance. However, if he was known for his faith in prayer and his acknowledgment of it, but in reality he did not pray, either always or sometimes he prayed and sometimes he did not, then in this case his heirs inherit from him.
