Is there a condition for plural marriage? And what is the ruling on marrying a Christian woman in this age?

Machine translationRead the Arabic original
The questioner : That is, if a man wants to marry a second, third, or fourth wife, is there a legal condition that must be met for him to marry? If a man wants to marry, people say to him, "Your wife is not giving birth, she is not giving you sons, she does not obey you, why do you want to marry?" It seems people have become convinced and raised in an environment where if a man wants to marry a second wife, there must be a condition, such as his wife not giving birth, or being sick, or something else. Is there a condition, and what is required of the man...

The Shaykh : Of course, there is a condition, but they say it is not a condition, it is conditions. You are softening the expression a little. The condition exists in the Qur'an.

The questioner : Yes.

The Shaykh : "If you cannot do it, then [marry] one."

The questioner : Yes.

The Shaykh : This is the condition.

The questioner : Yes.

The Shaykh : So whoever is able to be just between the women, it is permissible for him to marry a second, third, or fourth wife.

The questioner : Yes.

The Shaykh : And whoever is not able, it is not permissible for him.

The questioner : The only condition is that he is able to be just between them.

The Shaykh : How?

The questioner : The only condition is that he is able to be just between them.

The Shaykh : Yes. As for what you mentioned, that is merchandise coming from your country, unfortunately.

The questioner : A crime...

The Shaykh : And then, here the matter is different. If we want to speak the truth, here there is no condition except this condition mentioned in the Noble Qur'an. But without a doubt, the matter, as I say, is in another aspect related to women, which is that a Muslim marries a Jewish or Christian woman. It is not hidden from all present that this is permissible by the explicit text of the Noble Qur'an in His saying:
chaste women from among those who were given the Scripture before you والمحصنات من الّذين أوتوا الكتاب من قبلكم
[Al-Ma'idah 5:5]
But today I ask from people in countries like America and other lost youth: Is it permissible for a Muslim to marry a Christian woman? And I answer with the impermissibility. I do not feel that I am contradicting a text in the Noble Qur'an by this, because I am not saying it is absolutely impermissible, because such a statement would contradict the Qur'an. But I say, regarding the present situation and the poor Islamic upbringing, especially of women, and then men, I say, in addition to that, the answer is the prohibition of marrying a Christian woman, for example. We do not permit a righteous Muslim man to marry a wicked Muslim woman, that is, the open sinner who displays her adornment and leaves off prayer. So how do we permit a Muslim today to marry a Christian girl, when nothing remains with these Christians, especially in that country, of what is known among Muslims as honor and guarding one's chastity and modesty, and the like. We do not permit a Muslim to marry a wicked Muslim woman. Why? And here is the point: the horse is from the horse. We see today many young men, some have fallen into it, and some ask before they fall: "Is it permissible for me to marry? I am pleased with a girl, only with her morals and behavior, for example, she is not wearing the hijab, or for example, she does not pray." I say, no, it is not permissible for you to marry her. He says to me, "I will raise her." I say, she is full in your hand, raise her. We know many people who said the words, and the matter reversed; the woman became the one who raises the man, and the man who married the woman and let her dress however she wanted, and behold, she makes him shave his beard.

The questioner : Peace be upon you

The Shaykh : And upon you be peace and the mercy of Allah

The questioner : How is your health, my Shaykh? May Allah keep you well.

The Shaykh : Praise be to Allah, I am well

The questioner : May Allah bless you. Sorry for disturbing you. Perhaps we can ask you a question.

The Shaykh : Please, go ahead.

The questioner : May Allah increase your virtue, my Shaykh. I worked on a percentage of profits, twenty percent, after a year of work. We disagreed, so I requested a settlement of accounts. He presented a statement that there were no profits at all. May Allah bless you. I objected to this matter and have now presented evidence, because I was also writing down the sales.

The Shaykh: Yes

The questioner : And there is arbitration between our evidences.

The Shaykh: Yes

The questioner : The arbitrator said, "You do not have the right to present evidence because your books are not official." So I said to him, "Okay." So I request an oath regarding the estimation of these profits. If he swears that these are true, then I have nothing against you. But if he does not swear, then he is supposed to commit to what I present. My books are ready for inspection. So I ask from the legal perspective: Do I have the right to demand an oath or not? Just that?

The Shaykh: Yes

The questioner : Do I have the right, my teacher, or do I not have the right?

The Shaykh : How could you not have the right? You have the right.

The questioner: May Allah bless you.

The Shaykh :
But the proof (Bayyinah) lies on the one who is making the claim, and the other (Yamin) must be taken by the one who rejects the claim. البيّنة على المدّعي واليمين على من أنكر
Bulugh al-Maram 1423

The questioner : He says that my papers are not evidence.

The Shaykh : I understand, I understand. Because you do not have legal, legal evidence, for example. So it is he who must take the oath.

The questioner: May Allah bless you.

The Shaykh : And may Allah bless you.

The questioner : May Allah reward you with good.

The Shaykh : Welcome. Say, "Peace be upon you."

The Shaykh : So we do not say now that it is permissible, which is the original ruling in the matter. Likewise, we return to the matter of plural marriage. The previous condition is justice. But the horse is from the horse: Is it likely that the masses of people today, if they wanted to turn to repeating or multiplying wives, are capable of applying legal justice? This is less than little. Therefore, within the limits of fewness, we say we are of the opinion of permissibility, clearly.

The questioner: May Allah bless you.

The Shaykh : May you be blessed, yes.

The questioner : Peace be upon you

The Shaykh : And upon you be peace and the mercy of Allah.
