The questioner : Even though the hadith of Asma' in Sahih al-Bukhari states that she threw before the dawn. I asked one of the students of knowledge, at a level of knowledge that is not bad, and he said: The reconciliation between them is that the Messenger of Allah (peace and blessings be upon him) chose the most excellent for his family, while it is permissible for those who remain to throw before the dawn.

The questioner : Who are his family? I do not know about that?

The Shaykh : Good. Now we say, the hadith of Ibn Abbas is a statement and legislation from the Messenger (peace be upon him) on behalf of the Lord of the Worlds for the general Muslim community. And it is a prohibition

As for the hadith of Asma', it is an action of hers, and there is nothing in it indicating that it was done with the knowledge of the Messenger (peace and blessings be upon him), let alone with his permission. Is this clear?

The Shaykh : And thus, if two hadiths conflict, one being a marfu' report from the words of the Messenger and the other being a statement or action of some of the Companions, and that statement or action contradicts the statement of the Messenger (peace be upon him), then the statement of the Messenger is given precedence over the statement of anyone else. The Shaykh : Another thing: it is possible that Asma' (may Allah be pleased with her) was excused, and she considered it permissible to advance the throwing before the sun rises. And as the jurists say: "When doubt touches the evidence, the argument based on it falls." This is if there is no opposing evidence. But what about when the opposing evidence exists?
