What is the ruling on the adhan before the appearance of the dawn?

Machine translationRead the Arabic original
The questioner : I hear your voice... brother.
Another questioner: Regarding the Fajr adhan, the adhan currently given according to the official timings is at night.

The Shaykh : Yes.

The questioner : Well, we come, of course, it is supposed to be after the appearance of the twilight, after the appearance of the dawn, meaning

The Shaykh : Yes

The questioner : it is supposed that one gives the second adhan.

The Shaykh : Yes.

The questioner : So some people, of course, this is considered arguing without knowledge.

The Shaykh : Correct.

The questioner : You are disgusted by this process and you say to us, "We are innovating." So what is the correct opinion of the religion in this matter?

The Shaykh : Yes.

The questioner : And may Allah reward you with good.

The Shaykh : Before answering this question, I want to point out a common mistake among people, which is the questioner saying, "What is the opinion of the religion?" May Allah bless you, the religion has a ruling, not an opinion. An opinion comes from someone like me or you, who is subject to error and truth. As for the religion, it is all truth, as you know. Therefore, it is only correct to ask, "What is the ruling of the religion?" or "What is the ruling of the Shari'ah in such and such?" As for "What is the opinion of the religion?" that is an incorrect and common phrase among people, and we seek forgiveness from Allah. As for the answer to what you asked, there is no doubt that people today, unfortunately, are in great heedlessness regarding many legal issues. Among them is the Qur'anic text: today they call the adhan before the white thread of dawn becomes distinct from the black thread of night, exactly as I said. The night is still hanging its curtains and the land is covered in its darkness, yet they call the adhan. Without a doubt, the problem today, unfortunately, stems from the department responsible for this issue, which is the Ministry of Awqaf. It is they who approve this error and do not pay attention to those who warn them about its contradiction with the Shari'ah. Therefore, the imam or the mu'adhdhin who holds an official position will undoubtedly face difficulties and hardships regarding this common error if he wants to correct it. In my opinion, the gentlest treatment is for the responsible imam and the mu'adhdhin who is supposed to call the adhan to call the first adhan at what they consider the time of Fajr. He considers it the first adhan, then he waits until he sees the bright whiteness of dawn. At that time, he calls the second adhan and does not say in it, "Prayer is better than sleep," because the Sunnah is like this, as it came in Sunan al-Nasa'i and other books of the Sunnah, that when the Prophet (peace and blessings be upon him) taught Abu Mahdhurah the adhan, he said: then you call the second adhan like the other adhans, like the other prayers. There is no "Prayer is better than sleep" in the second adhan. This correct Sunnah must be submitted to and obeyed, and not opposed in practice. Second, the meaning of "Prayer is better than sleep" is: O sleepers, wake up and prepare to attend the Fajr prayer mentioned in the Qur'an in the statement of Allah the Exalted. As for the second adhan, when people have woken up and many of them have even rushed to the mosque, saying "Prayer is better than sleep" is not consistent with the legal text in terms of meaning. If the imam and the mu'adhdhin can do this, they will have done what is said: "They killed two birds with one stone." First, they revived the Sunnah of the first adhan, and second, they moved "Prayer is better than sleep" from the second adhan to the first adhan. And beyond these two stones is a third stone: that they maintain the performance of the Fajr prayer in its time. Every day, if Allah wills, with my brother and some of our other brothers, we go down from East Amman to a place called al-Nuzhah on the road known as al-Istiqlal Street to pray Fajr. Often, we pass by some mosques where they are praying, and we arrive there and the iqamah has not yet been called.
And eat and drink until the white thread of dawn becomes distinct to you from the black thread [of night] فكلوا واشربوا حتى يتبين لكم الخيط الأبيض من الخيط الأسود من الفجر
[Al-Baqarah 2:187]
At that time, he calls the second adhan and does not say in it"Prayer is better than sleep"because this is the Sunnah, as reported in Sunan al-Nasa'i and other books of the Sunnah, that when the Prophet (peace and blessings be upon him) taught Abu Mahdhurah the adhan, he said
So when you give the adhan for Fajr, give the first adhan before the appearance of the dawn and say in it, "Prayer is better than sleep, prayer is better than sleep." فإذا أذنت للفجر فأذّن الأذان الأول قبل طلوع الفجر وتقول فيه الصلاة خير من النوم الصلاة خير من النوم
Then you call the second adhan like the other adhans, like the other prayers; the second adhan does not include"Prayer is better than sleep"This authentic Sunnah requires one to submit to it, comply with it, and not oppose it in practice. Second, the meaning of"Prayer is better than sleep"meaning, "O you who are sleeping, wake up and prepare to attend the Fajr prayer, which is mentioned in the Qur'an in the statement of Allah the Exalted:
and [also] the Qur'an of dawn. Indeed, the recitation of dawn is ever witnessed. وقرآن الفجر إن قرآن الفجر كان مشهودا
[Al-Isra 17:78]
As for the second adhan, when the people have already woken up, and indeed many of them have already headed to the mosque, saying "Prayer is better than sleep" is, in terms of meaning, not in accordance with the Shari'ah text. If the imam and the mu'adhdhin can do this, they will have done what is said: "They killed two birds with one stone." First, they revived the Sunnah of the first adhan, and second, they moved "Prayer is better than sleep" from the second adhan to the first adhan. And beyond these two stones is a third stone: that they maintain the performance of the Fajr prayer in its proper time."They hit two birds with one stone"First, they revive the recommended practice of the first adhan, and second, they move"Prayer is better than sleep"from the second adhan to the first adhan, and beyond these two stones is a third stone, which is that they maintain the performance of the Fajr prayer in its proper time. Every day, if Allah wills, with my brother and some of our other brothers, we descend from East Amman to a place called al-Nuzhah on the road known as Independence Street to pray Fajr. On many occasions, we pass by some mosques where they are praying, and we arrive there and the prayer has not yet been established.

The questioner : ... .

The Shaykh : Yes, of course... they invalidate the worship of people because of this astronomical timing. This is not a legal timing.
Another questioner: ...

The Shaykh : Allah is the Greatest. Therefore, I hope that you will cooperate with some of the people of the neighborhood here, like Abu Ahmad and others, if Allah wills, from those who are eager to follow the Sunnah.

The questioner : Praise be to Allah.

The Shaykh : That you give the first adhan, which they give, and you say, as they say, "Prayer is better than sleep."

The questioner : Yes, of course.

The Shaykh : Then you give the second adhan, at least in the mosque, meaning without the loudspeaker.
Another questioner: My uncle said the same thing... he was walking beside me because...

The Shaykh : We told you, people are in heedlessness and ignorance.
Another questioner: The Fajr prayer, if Allah wills.
Another questioner: Because they raised their voices in the mosque... the matter came out, and my father, by Allah, used to give the adhan.

The questioner : But the environment...
Another questioner: They raised their voices in the mosque, of course, they put out their voices in the mosque and made a commotion.

The Shaykh : They made a commotion.

The questioner : But the neighborhood, praise be to Allah, the one we reached, the one we pray, and the dawn is fully up.

The Shaykh : Good.

The questioner : Praise be to Allah.

The Shaykh : This is a great blessing.

The questioner : The Hajj sometimes gives the adhan...
Another questioner: No, we go up, meaning we go up to the dawn from the houses, we pray the Sunnah, each one for himself, and then we pray.

The questioner : Each one for himself, and then.

The Shaykh : Good.

The questioner : Meaning, after the adhan, we sit for a while, meaning I hear the one beside me.

The Shaykh : Yes, yes, in the name of Allah.

The questioner : ... upon you, my uncle...

The Shaykh : ... the answer to this question.
Another questioner: Meaning, preferring the prayer over the tawaf, or the tawaf over the prayer.

The Shaykh : Your question... complete this. In the name of Allah, this hadith is weak in its chain.

The questioner : This is weak.
Another questioner: Yes
Another questioner: It is found in Riyad al-Salihin.
Another questioner: ... the biography, when the Prime Minister came...

The questioner : Yes.
Another questioner: Heh.
Another questioner: He said, can I...

The Shaykh : This is the darkness of the dawn, not the darkness of the night.

The questioner : It is after the dawn, it will be this.

The Shaykh : Of course, the dawn.
Another questioner: The remnants of the night, or...
Another questioner: ...

The Shaykh : How?
Another questioner: ... .

The questioner : ... .
Another questioner: There is in the book al-Jami' that they brought, its name is al-Fiqh 'ala al-Madhahib al-Arba'a?

The questioner : Yes
Another questioner: Subhan Allah, I was not impressed with any issue except the matter of the dawn, where it is explained completely, how the true dawn and the false dawn look, in full detail...

The Shaykh : Praise be to Allah, yes...

The questioner : People come to us with a belief, this is what we found our fathers upon.

The Shaykh :
Indeed, we found our fathers upon a nation, and we are following in their footsteps... إنا وجدنا آبائنا على أمة وإنا على آثارهم ...

The questioner : They were...
Another questioner: Ibn Umm Maktum and Bilal. Bilal used to give the adhan at night and say "Prayer is better than sleep", then the Companions would see the dawn. He was blind, so they would say, "It has become, it has become," and he would stand and give the adhan for Fajr, and they would pray.

The Shaykh : Yes
Another questioner: One of them who was... the most... come, I asked the scholars and they said, I seek refuge in Allah...
Another questioner: ... .

The questioner : ... one from the north, one from the south, one from the east, one...
