Questioned about the authenticity of the hadith: (Three whose supplications are not rejected . . . . ). ?

Machine translationRead the Arabic original
The Shaykh : Yes, please go ahead.

The questioner : May Allah bless you. I mentioned in *Da'if al-Jami'* a hadith narrated by Imam al-Tirmidhi and others:
Three whose supplications are not rejected: the just imam, the parent for his child, and the oppressed. Allah raises it above the clouds, then Allah the Mighty and Majestic says: By My might and My majesty, I will surely help you, even if after a long time. ثلاثة لا ترد دعوتهم الإمام العادل والوالد لولده والمظلوم يرفعها الله فوق الغمام ثم يقول الله عز وجل : وعزتي وجلالي لأنصرنك ولو بعد حين
I classified it as weak, then I saw it in *Sahih Sunan al-Tirmidhi* as authenticated. Does the ruling change for you?

The Shaykh : Authenticated with the same wording?

The questioner : With the same wording, but longer. It is the end of a long hadith in *Sahih Sunan al-Tirmidhi*, but the same wording.

The Shaykh : By Allah, there is likely an error in one of the two books, without a doubt. But why am I telling you it is the same wording? Because this hadith has a basis, but not with this completeness and wording... In any case, I am reviewing it. In *Sunan al-Tirmidhi*, do you remember which chapter and which number, so it is easy for us to review?

The questioner : There is no problem; it is known easily, because I made a note for myself when I read it today.

The Shaykh : Okay, if it is easy for you, call me on the phone, and may Allah reward you with good.

The Shaykh : Yes, please go ahead.

The questioner : A friend of mine asked me to consult you on an issue. This friend of mine is married.

The Shaykh : Raise your voice.

The questioner : He is married and has three children, and he wants to divorce his wife due to discord and conflict, claiming that she does not pray. Conflict arose between him and his wife, and he said to her: "Swear on the Quran." She took the Quran and threw it on the floor, and she curses and insults him with foul language. What is your advice for this young man?

The Shaykh : Of course, the religious advice is to hasten to get rid of her by divorcing her...
Three children. So, due to our ignorance of the character of this person, this husband afflicted with a wife of bad character, and this husband afflicted with such a woman, a hadith has come:
Three whose supplications are not answered: a man who has a wife of bad character and does not divorce her. ثلاثة لا تستجاب دعوتهم ورجل عنده امرأة سيئة الخلق ولا يطلقها
Therefore, we order him to divorce her, even if she were less bad than what you described of her just now. However, the presence of these children first, our ignorance of this husband's character second, and the strength of his faith third.
Or fourth: We cannot say that it is obligatory for him to hasten to divorce her, and that is the ruling. Because we fear that he is of that type, like that person who came to the Prophet (peace and blessings be upon him) and said:
O Messenger of Allah, my wife does not turn away the hand of a toucher. He said: Divorce her. يا رسول الله زوجتي لا ترد يد لامس ؛ قال : طلقها
Sunan al-Bayhaqi 10:1224
And I say to this man whom I do not know, "Divorce her." He said: "I love her." He said to him:
So keep her فأمسكها
What can he do with him? Because if he said to him: "Divorce her," and he divorced her, he might go and live with her in sin. No, by your compassion, some evil is less than some. He said to him:
when he told him to divorce her he replied that he loved her, so he told him that in that case he should keep her طلقها , قال : إني أحبها ، قال : فأمسكها
Mishkat al-Masabih 3317
This man you are talking about, in my opinion, it is obligatory for him to hasten to divorce her so that he may be relieved of her in this world and the Hereafter. But he will face the problem, and this happens to us often. Questions of this type reach us: "But I have so many children from her." Okay, what can I do for you? You know best. Can you endure without her and take care of her children, or give her the children and she takes care of raising them and improves their upbringing, and so on? These are matters we cannot first assess them to their full value and know the reality of their situation. And second: The master of the house knows best what is in it. So the answer is said to this person: "Divorce her, but look: if you divorce her, will you return to her and become humiliated with her if you take her back, more than the first state?" Where is our brother Wafiq? We need to ask permission. The time now, I think, is eleven and a third.
