The questioner : That he works in a shop, and some relatives and friends bring him money as a trust, and he mixes this trust into his business and benefits from it, and if they ask for it, he pays them back only the same amount they deposited with him. Is there anything required of him in this?
The Shaykh : Yes, there is something required of him in this. If a person is given dirhams as a trust with him, meaning a deposit, it is not permissible for him to dispose of them in any way. It is not permissible for him to put them in the shop’s cash box, nor is it permissible for him to use them for himself. If he does so, he is a traitor who has fallen into what Allah the Exalted said:[Al-Anfal 8:27], and he is contrary to what Allah the Exalted said: [An-Nisa 4:58]. However, if it is difficult for him to keep them separate in a specific place, he should say to the one who gave them to him, “Allow me to put them in the box with the general dirhams I have,” or “Allow me to dispose of them.” In that case, it becomes a loan, and it is obligatory for him to return the like of it if its owner asks for it. Yes.
The questioner : May Allah reward you. This listener, Kheir Allah from Jordan, says in his question.
