If a man is residing in Makkah and wants to perform 'Umrah, is it obligatory for him to go out to al-Hill? And if he is not from the people of Makkah but came to it as a guest near the House for a number of days?

The questioner : Your Eminence, if a man is residing in Makkah and wants to perform 'Umrah, is it obligatory for him to go out to al-Hill? And if he is not from the people of Makkah but came to it as a guest near the House for a number of days, does he also enter the state of ihram from al-Tan'im or elsewhere?

The Shaykh : What we see is that if a person performs 'Umrah, the Sunnah is to limit himself to that and not go out to al-Tan'im or to the miqat to perform another 'Umrah, whether he performs it for himself or for someone else. This is because the best of guidance is the guidance of the Messenger of Allah (peace and blessings be upon him), and the best of the generations of this Ummah are the Companions (may Allah be pleased with them). It was not their custom that when a person performed the first 'Umrah for which he came to Makkah, they would go out to al-Tan'im or to another place in al-Hill or to the miqat to perform another 'Umrah. But this occurred in the later eras when jurisprudence decreased in the Ummah, so the practice of things not based on the precedent of the Salaf increased. You will find some people going to al-Tan'im every day, or every two days, or every week to perform 'Umrah for their father, their mother, their grandfather, their grandmother, their uncle, their aunt, their maternal uncle, their maternal aunt, their neighbor, and their female neighbor, and so on. Every day he performs 'Umrah. Why? He says, for my father, for my mother, for my maternal uncle, for my maternal aunt, and the like. Is this from the guidance of the Salaf? The books of the Salaf are in our hands, praise be to Allah, and the Musnads and Sunans are available to us. None of them ever did this. The utmost that is reported is
That 'A'ishah (may Allah be pleased with her) entered the state of ihram for 'Umrah with the Prophet (peace and blessings be upon him) during the Farewell Pilgrimage. And during the journey, she started menstruating. So the Prophet (peace and blessings be upon him) came to her while she was crying and asked her why she was crying. She informed him, so the Prophet (peace and blessings be upon him) said: This is something Allah has decreed for the daughters of Adam.
Then he ordered her to combine Hajj with 'Umrah. When she finished Hajj, she said: O Messenger of Allah, the people are returning with 'Umrah and Hajj, and I am returning with only Hajj. She meant she wanted to perform 'Umrah. So he ordered her brother, 'Abd al-Rahman ibn Abi Bakr, and ordered him to take her for 'Umrah from al-Tan'im, meaning to take her out from al-Tan'im so she could perform 'Umrah. And the Prophet (peace and blessings be upon him) did not say to him, "Seize the opportunity and perform 'Umrah with your sister." He did not seize the opportunity to perform 'Umrah with his sister. This indicates that it was not their custom to go out from Makkah to al-Tan'im in order for a person to perform 'Umrah, contrary to what people are doing today. For this reason, I say: if you perform 'Umrah when you first arrive, close the door and do not perform 'Umrah for yourself or for anyone else. As for your father and your mother, if you insist on doing something for them, perform tawaf for them: one week for your mother and one week for your father, and this is sufficient. And if you want what is better and more complete, do what the Prophet (peace and blessings be upon him) guided to, where he said:
When a man dies, his acts come to an end, but three, recurring charity, or knowledge (by which people) benefit, or a pious child, who prays for him (for the deceased). إذا مات الإنسان انقطع عمله إلا من ثلاثة إلا من صدقة جارية أو علم ينتفع به أو ولد صالح يدعو له
Sahih Muslim 1631
And the Prophet (peace and blessings be upon him), who is the most sincere of creation to creation, did not guide us to do a deed for them, to do a deed for our fathers or mothers. Rather, he guided us to make du'a for them, saying:
or a pious child, who prays for him أو ولد صالح يدعو له
Sahih Muslim 1631
And he did not mention righteous deeds, even though the hadith is in the context of what? In the context of what? In the context of deeds. And if it is in the context of deeds, the Prophet's (peace and blessings be upon him) turning from deeds to du'a is proof that du'a is better than deeds. Otherwise, he would have said, "Or a righteous son who prays for him." For this reason, I say that the customs people follow today in being absorbed in 'Umrahs for their deceased and repeating 'Umrah is not from the guidance of the Prophet (peace and blessings be upon him) nor from the guidance of the righteous Salaf. If it had been good, they would have preceded us to it. We said he should tawaf for them for a week or two weeks. No one should understand the meaning to be that he remains circling the Ka'bah, tawafing for a full week or for two weeks. The meaning is that seven circuits are called a week. So if we say he tawafs
a week around the House means seven circuits. Two weeks means seven circuits and seven circuits. This is the meaning.
