Question:
From Buraydah in the Qassim region, the listener: (A. M. M) says: I am a young man from the Noble Makkah, and I currently reside in the Qassim region for studies. In the past Ramadan and the one before it, I went to Makkah in the early days of Ramadan, and it was my intention to perform the rites of 'Umrah in the last ten days of Ramadan. So I stayed in Makkah with my family until the last ten days, then I entered the state of ihram from my house in Makkah. One of the brothers informed me that I had made a mistake, and that it was obligatory for me to go to the miqat to enter ihram. Is there anything required of me, given that I am a resident of Makkah—as I mentioned before—and I am temporarily residing in Qassim for studies? May Allah reward you with good.

Answer:
If you are a resident of Makkah, and you did not intend to settle in Qassim, but only stayed for studies, otherwise you are on the intention of settling in Makkah and remaining there, then there is nothing required of you. But if you entered ihram from Makkah from within the same Haram, then you must offer a sacrificial animal to be slaughtered in Makkah for the poor. However, if you went out to the Haraam, such as al-Ja'ranah, or 'Arafah, and entered ihram from there, then there is nothing required of you. Yes.

The Shaykh : A sacrificial animal is necessary as long as you entered ihram from the house; so you must offer a sacrificial animal to be slaughtered in Makkah for the poor; because it is obligatory for the residents of Makkah, if they intend to perform 'Umrah, to go out to the Haraam, as the Prophet (peace and blessings be upon him) ordered 'Aishah to go out to the Haraam, so she entered ihram from al-Tan'eem, (may Allah be pleased with her).
The point is: the non-resident stranger must enter ihram from the miqat when he arrives, ... from the miqat that he passes by, such as the person from Qassim who enters ihram from the miqat of as-Sail, and likewise the person from Riyadh and the like, and the one who comes to Makkah from Madinah from the miqat of Madinah, and likewise the one who comes from Yemen from the miqat of Yemen, or the one who comes from the Levant from the miqat of the Levant, and Egypt like al-Juhfah.
The point is: the one who is in Makkah and intends to perform 'Umrah; he goes out to the Haraam, such as al-Tan'eem, al-Ja'ranah, and 'Arafah, and the like. So if he enters ihram from Makkah itself; then he must offer a sacrificial animal; because he entered ihram from other than the miqat.
