Question:
May Allah reward you. If the people of Makkah wish to perform 'Umrah, do they enter the state of ihram from their homes, or are they required to go out to the area outside the sacred precinct (al-Hal)? And what about those who reside in Makkah but are not originally from there?

Answer:
Whoever wishes to perform 'Umrah while in Makkah, whether he is a resident of Makkah or a visitor coming to it, it is not permissible for them to enter the state of ihram for 'Umrah from Makkah. Rather, they must go out to al-Hal, to at-Tan'eem, al-Ja'ranah, or 'Arafah. They must go out to al-Hal, outside the miles (the boundary markers). If 'Umrah were valid from Makkah, the Prophet (peace and blessings be upon him) would not have taken 'A'ishah out to at-Tan'eem when she wanted to perform 'Umrah. He took her out to at-Tan'eem because at-Tan'eem is the nearest point of al-Hal. This indicates that one does not enter the state of ihram for 'Umrah from Makkah. Rather, it is Hajj for which one enters the state of ihram from Makkah. This is contrary to 'Umrah because a ritual (naqs) must combine both al-Hal and al-Haram. Hajj combines al-Hal and al-Haram, unlike 'Umrah, all of whose acts are performed in al-Haram. Therefore, one must go out to al-Hal and enter the state of ihram there, as 'Umrah combines al-Hal and al-Haram. Yes.
