The questioner : The questioner says: I came to Makkah to fulfill a need, then I wanted to perform 'Umrah. What are the arrangements I must carry out so that my 'Umrah conforms to the guidance of the Messenger of Allah (peace and blessings be upon him)?

The Shaykh : This man who came to Makkah for a need, without initially intending to perform 'Umrah, but then decided while in Makkah to perform 'Umrah, it is obligatory for him to go out to the nearest part of al-Hil, meaning he must go out to al-Hil to enter the state of ihram for 'Umrah. The nearest part of al-Hil to Makkah is at-Tan'eem. So he goes to at-Tan'eem, which is known among the common people as the Mosques of 'Aishah, and enters ihram from there. If he goes out to 'Arafah and enters ihram from there, it is permissible. If he goes out to al-Ja'ranah and enters ihram from there, it is permissible. If he goes out to al-Hudaybiyah from the direction of Jeddah and enters ihram from there, meaning from al-Hil, it is permissible. The important point is that anyone who wants to perform 'Umrah while in Makkah, whether he is a resident of Makkah or a visitor to it, it is not permissible for him to enter ihram from Makkah. Rather, it is obligatory for him to go out to al-Hil and enter ihram from there. This is because the Prophet (peace and blessings be upon him) said to 'Abd al-Rahman ibn Abi Bakr (may Allah be pleased with them both) when 'Aishah asked the Messenger of Allah (peace and blessings be upon him) to perform 'Umrah, he said to him:
Take out your sister from the precincts of the Ka'ba in order to put on Ihram for Umra اخرج بأختك من الحرم فلتهل بعمرة

And in his saying:
from the precincts of the Ka'ba in order to put on Ihram for Umra من الحرم فلتهل بعمرة

is evidence that the Haram is not a miqat for entering ihram for 'Umrah.
