The questioner : He says: We are among those who claim descent from Banu Hashim, and there are needy, poor, and destitute people among us, indeed some of the poorest people, who have nothing to spend except for the social security benefits for the elderly and the aged only. Is it permissible to give them charity, whether this charity comes from a Hashimite like them or from a non-Hashimite? And what is the ruling if one gives to them?

The Shaykh : If the charity is voluntary charity, then it is given to them, and there is no blame on you in this. But if it is obligatory charity, then it is not given to them, because the Prophet (peace and blessings be upon him) said:
It is only people's impurities. إنما هي أوساخ الناس
Muwatta Malik 58:13
And Banu Hashim were honored by Allah (Mighty and Majestic) by not taking from people their filth. As for voluntary charity, it is not filth in reality, and although it undoubtedly expiates sins, it is not like the obligatory zakah. For this reason, many scholars held that they are given from voluntary charity but not from obligatory charity. Yes.
