The Shaykh : What is the ruling on what is called al-huquq, or the tying of a sheep or two sheep? The right, meaning between the tribes. There are people in a dispute, one... The punishment, what does that mean? Yes, the punishments that the one in authority legislates. As for what occurs among people, such as when they say, "If a person makes a mistake in something, you must offer a sacrifice, you must pay one hundred riyals, you must take us on an outing for a picnic," all of this is invalid compulsion that entails consuming the wealth of people without right. If a man makes a mistake in the slightest word, if he intends to say "O Muhammad" to address a person named Muhammad but says "O Abdullah," and the other says, "Done, you called me Abdullah, you owe me a right," who said this? Who said this? And by what do you compel him to pay this money? The Prophet (peace and blessings be upon him) said:
If you were to sell fruits to your brother) and these is a stricken with Calamity, it is not permissible for you to get anything from him. Why do you get the wealth of your brother, without jutification? إذا بعت من أخيك ثمراً فأصابته جائحة فلا يحل لك أن تأخذ منه شيئاً بم تأخذ مال أخيك بغير حق
Sahih Muslim 1554a
The point is his statement: "By what do you take the wealth of your brother without right?" These rights that some people impose on a person who has not done what necessitates them, we say are invalid, and it is not permissible for a person to compel his brother to such rights. Yes.
