Question:
What is now widespread among people is what is called "rights." So if a dispute arises between two people, one of them says: "If the mistake was mine, then I have a right [to be compensated], and if the mistake was yours, then you have a right [to be compensated]." They then refer the matter to a third person, who says: "The mistake was this one's," or "The mistake was this one's," and then the right is established against the person who made the mistake?

Answer:
If they reach a settlement without compulsion, there is nothing wrong with it. As for compulsion, it is not obligatory except by the Shari'ah. However, if they say: "O so-and-so, we have agreed to you, so reconcile us," there is nothing wrong with it.
