The questioner : He says:The questioner : Some people will bequeath that they be buried in a city other than the one in which they died, and they say: Bury me next to my fathers and grandparents in such-and-such a city. So they shroud him in the city where he died and transport him to that city to be buried there. Is his bequest to be carried out?

The Shaykh : Yes, when a person dies in a country, he is buried there, because all people will be gathered on the Day of Resurrection in one place, no matter how far apart the lands are. It is not befitting for a person to burden those who come after him by bequeathing that he be carried to such-and-such a country or such-and-such a place, because that may be difficult for them and lead to delaying his burial. Delaying the burial is contrary to the Sunnah. On this occasion, I would like to remind my brothers that the Prophet (peace and blessings be upon him) informed us
That when a man is carried out of his house dead, and he was among the righteous, his soul says, "Hasten us, hasten us." And if he was otherwise, his soul says, "Woe to her, where are you taking her?" أن الرجل إذا خرج الناس به من بيته ميتاً وكان من الصالحين فإن روحه تقول قدّموني قدّموني وإن كان على خلاف ذلك فإن روحه تقول يا ويلها أين تذهبون بها
and it is established from him (peace and blessings be upon him) that he said:
Walk quickly with a funeral, for if the dead person was good it is a good condition to which you are sending him on, but it he was otherwise it is an evil of which you are riding yourselves. أسرعوا بالجنازة فإن تك صالحة فخير تقدّمونها إليه وإن تك سوى ذلك فشر تضعونه عن رقابكم

And if that is the case, then it is a wrong done to the deceased to hold him back and not bury him for a day or two in order for his relatives to come and attend his funeral. This is an error, contrary to the Sunnah in one respect, and a wrong to the deceased in another. We hope the deceased is righteous, and he would wish to be hastened to his grave and to the bliss that is greater than the entire world. When a person is placed in his grave and two angels come to him and ask him about his Lord, his religion, and his Prophet, and he answers correctly, his grave is made spacious for him to the extent of his sight, and a door to Paradise is opened for him, and he is brought from its bliss. If we hold him back from that, we have wronged him. Some people say, "His son, or his full brother, or his father is absent; we do not want to bury him without his presence." We say: Praise be to Allah, if these people come, they can pray over him, because praying over the grave is permissible. A woman who used to clean the mosque in the time of the Messenger (peace and blessings be upon him)—a woman who cleaned the mosque, meaning she swept it—died at night, and the Companions (may Allah be pleased with them) buried her. The Prophet (peace and blessings be upon him) asked about her when he missed her. They said, "O Messenger of Allah, she has died." He said:
Why did you not inform me? هلا كنتم آذنتموني
meaning, did you not inform me? It seems they belittled her and diminished her status. So he (peace and blessings be upon him) said:
Show us her grave, so they showed him her grave, and he (peace and blessings be upon him) went out to al-Baqi' and prayed over her. دلوني على قبرها، فدلوه على قبرها، فخرج عليه الصلاة السلام إلى البقيع وصلى عليها
So we say to these people: if his father, or his son, or his brother, or his friend arrives, he prays over his grave, and the intention is to make supplication for him, and that has been achieved. But to hold back the funeral of the deceased for the sake of a person who will arrive after a day or two, this is an error, contrary to the Sunnah, and a wrong to the deceased. Rest, your turn will come, if Allah wills.

The questioner : He says:The questioner : A man came from Egypt for 'Umrah, and while he was in Makkah, he felt a severe illness. Then he entered the state of ihram from Dhu al-Hulayfah, and the illness increased. He woke up in the hospital and had already broken his ihram. What is the ruling, and is it permissible for him to enter the state of ihram from Tan'im after his recovery?
