Q 1: Some people, when they are on their deathbed, bequeath that they be buried in the city where they lived or in their village. What is obligatory for their awliya (close friends of Allah)? Is it obligatory or recommended for them to carry out that bequest? And if it is not permissible, is there a specific distance within which it is permissible to transfer the body, but not beyond? Also, some people, when their father dies in a city that is one hundred kilometers away, transfer their father to their hometown where they reside, on the pretext that they want him to be near them so that they can visit him and make du'a' (supplication) for him at his grave. Is that permissible for them?
A 1 : If the deceased bequeaths that he be buried in a specific place or a certain country, it is not obligatory to act upon his bequest. Rather, the Sunnah is to hasten to prepare him and bury him with the Muslims in the cemetery of the city where he died. This is based on the saying of the Prophet (peace and blessings be upon him):Sunan Abi Dawud 3159Da'if (Al-Albani) narrated by Abu Dawud in his (Sunan), and the saying of the Prophet (peace and blessings be upon him): Sunan Abi Dawud 3181Sahih (Al-Albani) and the generality of the evidence that encourages hastening with the funeral to the cemetery.
