A man who has intercourse with his wife before she performs the ghusl for post-natal bleeding: is there an expiation on him?
Machine translationRead the Arabic original
The questioner : May Allah reward you, O Shaykh. This man says: He had intercourse with his wife before she performed the ghusl for post-natal bleeding. Is there an expiation on him?
The Shaykh : Allah, Blessed and Exalted is He, said:[Al-Baqarah 2:222] His saying: means that when they have performed the ghusl. The evidence that purification means performing the ghusl is the saying of the Exalted: [Al-Ma'idah 5:6] Therefore, it is not permissible for a man to have intercourse with his wife when she has been purified from menstruation until she performs the ghusl, and it is not permissible for him to have intercourse with her when she has been purified from post-natal bleeding until she performs the ghusl. However, he may have intercourse with her other than in the private parts even if she has not performed the ghusl, and even if she is menstruating or has post-natal bleeding, because the Prophet (peace and blessings be upon him) said regarding the menstruating woman: Sahih Muslim 302
The questioner : Expiation
The Shaykh : There is no expiation.
The Shaykh : Allah, Blessed and Exalted is He, said:
And they ask you about menstruation. Say, "It is harm, so keep away from wives during menstruation. And do not approach them until they are pure. And when they have purified themselves, then come to them from where Allah has ordained for you.
ويسألونك عن المحيض قل هو أذى فاعتزلوا النساء في المحيض ولا تقربوهن حتى يطهرن فإذا تطهرن فأتوهن من حيث أمركم اللهThen when they have purified themselves
فإذا تطهرنAnd if you are in a state of janabah, then purify yourselves
وإن كنتم جنباً فاطهرواDo everything except intercourse
اصنعوا كل شيء إلا النكاحThe questioner : Expiation
The Shaykh : There is no expiation.
