Q: The questioner had intercourse with his wife during her postpartum bleeding after twenty days had passed since her delivery. He has heard from the preachers in the mosques that a woman who has not completed her postpartum waiting period, if her bleeding stops during the postpartum period, should perform the full ritual bath and pray. He asks what is required of him regarding his intercourse before the end of the postpartum period?
A:Praise be to Allah alone, and may peace and blessings be upon His Messenger, his family, and his Companions. After that:The maximum duration of post-natal bleeding, according to the majority of scholars, is forty days and nights; as narrated byAbu Dawudand al-TirmidhifromUmm Salimah(may Allah be pleased with her), who said:Jami` at-Tirmidhi 139Hasan (Darussalam), andal-DaraqutnifromUmm Salimah, that she, andAbu 'Isa al-Tirmidhisaid: (The scholars of knowledge agreed that
The ruling on having intercourse with a woman with postpartum bleeding while the blood is flowing is forbidden, just like intercourse with a menstruating woman. Whoever does that must seek forgiveness from Allah and repent to Him. He must also give charity of a dinar or half of it as expiation for what occurred from him; based on what was narrated by Ahmad and the compilers of the Sunan with a good chain from Ibn 'Abbas (may Allah be pleased with them both) that the Prophet (peace and blessings be upon him) said regarding one who has intercourse with his wife while she is menstruating: . The amount of the dinar is four-sevenths of the Saudi riyal. So if the exchange rate of the Saudi riyal is, for example, seventy riyals, you must give out forty riyals, or twenty Saudi riyals, to be given in charity to the poor. However, if your intercourse with your wife with postpartum bleeding occurred during a period when the blood had stopped and after she had performed the full ritual bath, then you owe nothing, even if you had not completed the forty days. And success is from Allah, and may Allah send blessings and peace upon our Prophet Muhammad, his family, and his Companions.
