Ruling on a man who has intercourse with his wife during menstruation or post-natal bleeding
Machine translationRead the Arabic original
The question: Also, in his letter he says: I have heard some people say: If a man has intercourse with his wife before the forty days are completed—meaning: from the post-natal bleeding—it is as if he is committing adultery with her. What is the ruling if he does that? Is he required to pay an expiation or repent to Allah? And if he has intercourse with her while she is menstruating, they say the same thing. Please inform us, may Allah reward you with good for all of us?
The answer: It is not permissible for the husband to have intercourse with a menstruating woman or a woman in post-natal bleeding. It is forbidden for a man to have intercourse with his wife during menstruation or post-natal bleeding. For this reason, Allah the Exalted says: [Surat al-Baqarah: 222]. Therefore, it is not permissible for the husband to approach his wife during menstruation until she takes a full ritual bath, purifies herself, and bathes from her menstruation. Then he may have intercourse with her. Likewise, it is not permissible for him to approach a woman in post-natal bleeding while the blood is present. If she purifies herself and takes a full ritual bath, it is permissible for him to have intercourse with her, even if she is within the forty days. If she purifies herself after one month and takes a full ritual bath, it is permissible for him to have intercourse with her during the remaining ten days. She must then pray and fast, and she becomes lawful to her husband for the remainder of the forty days. This is because there is no fixed limit for the minimum duration of post-natal bleeding. She may purify herself after twenty days, after thirty days, or after less or more. If she purifies herself and takes a full ritual bath, she must fast and pray, and her husband may approach her during the time of purity. However, during the time of bleeding, he may not.
If she completes the forty days, it is obligatory for her to take a full ritual bath, even if the blood is still present. If the blood continues with her until she completes the forty days, the period ends. She must take a full ritual bath, even if the blood is flowing, and she must pray and fast. She considers this blood to be corrupt blood that does not prevent her from fasting and praying, nor does it prevent her husband from approaching her. This is because this continuous blood is considered corrupt blood after the completion of the forty days. The end and completion of post-natal bleeding is forty days. If the forty days end, then the post-natal bleeding has ended. The woman must take a full ritual bath, and she must pray and fast if it is Ramadan, and she becomes lawful to her husband, even if the blood is flowing. Because, in the situation described, it is corrupt blood that is not considered.
If a man has intercourse with his wife during menstruation or post-natal bleeding, he has done wrong, committed a sin, and committed a major sin. It is obligatory for him to fear Allah and to repent to Him, the Exalted and Majestic, for what he did. Repentance wipes out what came before it. In addition to that, according to the stronger of the two opinions of the scholars, he must pay an expiation, which is half a dinar or a dinar, if he approached his wife during menstruation. The same applies to post-natal bleeding. He must pay the expiation along with repentance to Allah, regret, ceasing the act, and a sincere resolve not to return to it. The expiation is a dinar or half a dinar of gold, or its value in silver. The amount of half a dinar from the Saudi riyal today is two-sevenths, because the Saudi riyal today is two and a quarter dinars, meaning: two and a quarter mithqals. So half a dinar from it is two-sevenths, and a dinar is four-sevenths. He must expiate with that if he approached his wife while she was menstruating or in post-natal bleeding. He should look into the exchange rate of the Saudi riyal, and when he knows from the money changers, he takes out the amount of two-sevenths of the exchange rate of the riyal, and he gives it in charity to some of the poor. Or four-sevenths, excluding the dinar, and he gives it in charity to some of the poor as repentance to Allah, the Mighty and Majestic, and as expiation for the intercourse he committed during menstruation or post-natal bleeding while the blood was coming out. As for after purification, there is nothing in that. If she purifies herself and takes a full ritual bath from her menstruation or post-natal bleeding, she becomes lawful to the husband, as mentioned earlier. Yes.

And they ask you about menstruation. Say, "It is harm, so keep away from wives during menstruation. And do not approach them until they are pure. And when they have purified themselves, then come to them from where Allah has ordained for you. Indeed, Allah loves those who are constantly repentant and loves those who purify themselves."
