What is the authenticity of the hadith, “Whoever swears by trust is not one of us,” and the hadith, “Kill the poisoners, even if they are on my grave”?

Machine translationRead the Arabic original
The questioner : May Allah reward you. What is the authenticity of these two hadiths? The first hadith is:
He who swears by Amanah (faithfulness) is not one of us. من حلف بالأمانة فليس منا
Sunan Abi Dawud 3253Sahih (Al-Albani)
.
The second hadith is:
Kill the poisoners, even if they are on my grave اقتلوا السموم ولو على قبري
.

The Shaykh : What?

The questioner : Kill the poisoners, even if they are on my grave.

The Shaykh : Poisoners? What are poisoners?
The student: ... .

The Shaykh : ... .
The student: The *samsum* (poisonous plant).

The Shaykh : Is its name *samsum*? ...
The student: ... .

The Shaykh : Yes, it is not obligatory. In any case, the first hadith,
He who swears by Amanah (faithfulness) is not one of us. من حلف بالأمانة فليس منا
Sunan Abi Dawud 3253Sahih (Al-Albani)
, has been narrated from the Prophet (peace and blessings be upon him), but there is a concern regarding it. The most authentic of these is the saying of the Prophet (peace and blessings be upon him):
Whoever has to take an oath should swear by Allah or remain silent. من كان حالفا فليحلف بالله أو ليصمت
Sahih al-Bukhari 2679
. For this reason, we say that swearing by other than Allah is shirk (associating partners with Allah), which may be major shirk or minor shirk. Therefore, it is not permissible for a person to swear by trust, nor by the Prophet, nor by Gabriel, nor by the earth, nor by the sky, nor by the sun, nor by the moon. One does not swear except by Allah or by one of His attributes.
If someone were to say: We find in the Qur'an swearing by the sun and the moon and the like.
The answer is to say that Allah (Glorified and Exalted is He) rules and is not ruled over, and He has the right to swear by whatever He wills of His creation. As for us, we do not swear except by what we have been permitted to swear by, which is Allah (Mighty and Majestic) or one of His attributes. It is permissible, for example, to say, “By Allah, I will certainly do such and such,” or “By the Most Merciful, I will certainly do such and such,” or “By the All-Hearing, the All-Seeing, I will certainly do such and such,” or to say, “By the majesty of Allah, I will certainly do such and such,” or “By the wisdom of Allah, I will certainly do such and such,” and the like. Swearing by other than Allah is shirk (associating partners with Allah). Whoever hears someone swearing by other than Allah should advise him, because he may be swearing by other than Allah out of ignorance of this. It is obligatory for the knowledgeable person to advise the ignorant one. Yes.

The questioner : May Allah reward you. He says.

The Shaykh : As for the second hadith, which says, what was it?
The student: ... .

The Shaykh : “Kill the poisoners, or I don’t know what it is, even if they are on my grave.” This is not authentic. Yes. And among what is forbidden to kill, if it is like what one of you mentioned, ants, then it is forbidden to kill ants. Yes.
