What is the ruling on one who enters the state of ihram for tamattu', performs 'Umrah, then goes to Jeddah where his family is, and then returns to Makkah on the eighth day for Hajj?

The questioner : Peace be upon you.

The Shaykh : And peace be upon you.

The questioner : If one enters the state of ihram from the miqat of the people of al-Madinah for Hajj and goes to Makkah and performs 'Umrah on the third of Dhu al-Hijjah, and after finishing the 'Umrah goes to Jeddah where his family is, and on the eighth day descends to Makkah, is it permissible for him to travel from Makkah to Jeddah after finishing the 'Umrah?

The Shaykh : If a person enters the state of ihram for tamattu' from 'Umrah to Hajj and finishes the 'Umrah, he may travel to his home or elsewhere. However, if he travels to his home and then returns from his home in the state of ihram for Hajj, his tamattu' is broken, and he becomes a mufrid (one who performs Hajj alone). This is because his first journey was broken by his return to his home. So, if he initiates a journey for Hajj, he initiates a new journey and becomes a mufrid. But if he travels to another country other than his home and then returns from that country in the state of ihram for Hajj, he remains a mutamatti' (one performing tamattu'). This is the correct opinion in this issue.
Some scholars said: If he travels between the 'Umrah and Hajj a distance that allows for shortening the prayer, his tamattu' is broken, whether he travels to his home or to a place other than his home.
Some scholars said: If he travels, his tamattu' is not broken, whether he travels to his home or to a place other than his home. But the middle opinion is the one we choose: it is to distinguish between his return to his home and his return to another place.
This is what was narrated from the Commander of the Faithful, 'Umar ibn al-Khattab (may Allah be pleased with him), and it is what the meaning requires. Because the reality of the matter is that if he returns to his home and then comes back from there in the state of ihram for Hajj, the reality is that he did not achieve tamattu' between the 'Umrah and Hajj in one journey. Rather, they are two independent journeys, meaning each one is independent of the other.

The questioner : ... .

The Shaykh : In your example that you mentioned, if he returns to Jeddah, if he returns to Jeddah, then when he returns to Makkah, he must enter the state of ihram for Hajj from Jeddah.

The questioner : From the miqat of al-Madinah to Makkah?

The Shaykh : From the miqat of al-Madinah to Makkah, this is for the 'Umrah. Then he went out to his family in Jeddah. So when the season of Hajj came, he entered the state of ihram for Hajj from Jeddah and performed Hajj.

The questioner : He will be a mufrid.

The Shaykh : He will be a mufrid.

The questioner : May Allah reward you with good.
