The questioner : I have a sister who has been married to a man who is a relative of the family for five years, and she has three children from him. However, for the past three years, this man has changed and no longer commits to his home, drinks intoxicants, may Allah protect us from that, and returns home after midnight, and does not provide for his wife and children. Is my sister, the wife, entitled to request a divorce from him? Knowing that he refuses the divorce, and knowing that his financial situation is very comfortable, what is the ruling of the Shari'ah in your view regarding this?
The Shaykh : Praise be to Allah, Lord of the worlds, and I send prayers and peace upon our Prophet Muhammad, the Seal of the Prophets and the Imam of the Pious, and upon his family and his Companions, and those who follow them with excellence until the Day of Judgment:
This situation that has befallen the woman's husband is unusual. According to what was stated in the question, this man has been blessed by Allah, and it is befitting for one whom Allah has blessed to be grateful for Allah's blessing, Glorified and Exalted is He, by performing His obedience and avoiding His disobedience. There is no doubt that this man has added to his injustice against himself his injustice against his wife and children, as he does not provide for them.
Your sister is entitled to request the annulment of the marriage from this man whose condition has changed to this bad state of drinking intoxicants and being absent from home frequently.
I am offering advice to this man, hoping that Allah the Exalted will convey it to him, to fear Allah in himself, his family, and his children, and to know that the more Allah's blessings increase upon him, the more obligatory it becomes for him to be grateful. If he does not do so while the blessings continue, let him know that this is a luring from Allah, Glorified and Exalted is He. And Allah the Exalted said:[Al-A'raf 7:182-183] And the Prophet (peace and blessings be upon him) said: إن الله ليملي للظالم حتى إذا أخذه لم يفلته وتلا قوله تعالى : وَكَذَلِكَ أَخْذُ رَبِّكَ إِذَا أَخَذَ الْقُرَى وَهِيَ ظَالِمَةٌ إِنَّ أَخْذَهُ أَلِيمٌ شَدِيدٌ Indeed, Allah gives respite to the wrongdoer until when He seizes him, He does not let him escape. And he recited His saying, the Exalted: And thus is the seizure of your Lord when He seizes the towns while they are wrongdoers; indeed, His seizure is painful and severe. I ask Allah for guidance for us and for him to His straight path.
The questioner : May Allah bless you.

(182) But those who deny Our signs - We will progressively lead them [to destruction] from where they do not know. (183) And I will give them time. Indeed, my plan is firm.
