Explanation of the Book of the Adhan-06b

Machine translationRead the Arabic original
The reader: Mu'adh ibn Asad narrated to us, Abdullah narrated to us, Ma'mar narrated to us from al-Zuhri, who said: Mahmud ibn al-Rabi' informed me, saying: I heard 'Utbah ibn Malik al-Ansari say: The Prophet (peace and blessings be upon him) asked for permission to enter, so I gave it to him. He then said:
Where do you want me to pray in your house? أين تحب أن أصلي من بيتك
Sahih al-Bukhari 839, 840
I indicated to him the place I preferred, so he stood up and we lined up behind him. Then he said the closing salam, and we said it.

The Shaykh : This also, this heading contains a type of discrepancy with the hadith of Ibn Mas'ud
No man must lead another in prayer where (the latter) has authority لا يؤمن الرجل الرجل في سلطانه
Sahih Muslim 673a
because the heading is absolute, whereas if it had said "with their permission," the issue would be resolved. The hadith does not indicate the absoluteness implied by the heading, because the hadith explicitly states that 'Utbah, what did he do? He asked for permission and it was granted. So if one visits a group of people, if they give him permission to be the imam, then he is the imam. If they do not give him permission, then the owner of the house is more entitled to lead the prayer, because those who came to the house were under his authority. And the Prophet (peace and blessings be upon him) said:
No man must lead another in prayer where (the latter) has authority لا يؤمن الرجل الرجل في سلطانه
Sahih Muslim 673a
Yes.
The reader: ...

The Shaykh : The issue is when the imam visits a group of people and leads them in prayer.
The reader: ...

The Shaykh : But if he leads them with the permission of the imam behind the imam, it is possible that "the imam" refers to the supreme imam, meaning the ruler of the state. It is also possible that it refers to the imam who appointed himself as the imam. If it is the former, there is no issue, as I said. If it is the latter, there is an issue.
