Continuation of the ruling on one who married with forbidden wealth while not knowing of its prohibition.

The questioner : His EminenceThe Shaykh : I had an agricultural certificate for about fifty tons. A man came to me and said, "I will give you one riyal per kilo," meaning he was buying the certificate for fifty thousand riyals, while the price of wheat was two and a half riyals... So he gave me the sum of fifty thousand riyals in advance. After a while, I discovered that it was forbidden. Knowing that I married with this amount, what is obligatory for me?

The Shaykh : I see that it is obligatory for you to give this amount in charity. Give this amount in charity because it did not enter your ownership. As for the marriage, the marriage is valid and there is no problem with it, if Allah wills.

The questioner : Knowing that I am currently in debt and I am unable to give, for example, fifty thousand riyals in charity. I did this out of ignorance; I was ignorant about selling the certificate because I did not know whether it was forbidden or permissible.

The Shaykh : There is no sin on you, if Allah wills, regarding what happened in the past, because you were ignorant. But these riyals that came to you came without right, rather through lying and betraying the state. I think you have wronged your partner; you have wronged him now and brought upon him wealth that is forbidden for him. The Messenger of Allah (peace and blessings be upon him) said:
Help your brother, whether he is an oppressor or he is an oppressed one. انصر أخاك ظالماً أو مظلوماً
Sahih al-Bukhari 2443
It was mentioned that helping the oppressor is to prevent him from oppression. If it is easy for you, give it in charity. If you are poor and you remain until Allah wills for you to depart from this world, then if Allah wills, nothing is required of you, because this is a right for Allah, and Allah the Exalted does not burden a soul beyond its capacity.

The questioner : What if he agreed? He was the one who offered it to me?

The Shaykh : No, even if he agreed. Do not the usurers agree? Are they not dealing in riba now under compulsion or by choice?

The questioner : By choice.

The Shaykh : By choice. Therefore, do not return it to him. Do not return this to him; give it in charity.
