The fourth message in this session was received from the questioner, Abkar Jum'a Tanbil, from the city of Al-Abiyad in eastern Sudan. He says: There is a person who married with a mix of lawful and unlawful wealth. After a period of years, his heart became aware and he realized that he had married with unlawful wealth. What is his ruling? And what must he do?
The answer: The marriage is valid, and this does not harm it, as long as the conditions were met: that he married her with her consent, with the legal guardian, and with witnesses, and she was in a state where there was no impediment to marriage. So the fact that there is something forbidden in the mahr does not harm the marriage, if the conditions of the nikah are present and only some of the money was defective, becoming partly forbidden. This does not invalidate the marriage. He must repent to Allah for what he took of the forbidden, and he must return the money to its rightful owner if he stole it from someone or usurped it from someone; he should return it to its owner. If he is unable to do that, he should give it in charity on behalf of its owner in the causes of righteousness, such as the poor and the needy, repairing roads, and restrooms around mosques, and the like of that. As for the marriage, it is valid. Yes.
