The questioner : This questioner, Ahmad Hussein, says: O honorable Shaykh, in our town, graves are built with red brick that has been fired or with cement brick, and the height of the grave is more than a meter, and these graves are whitewashed with cement. And when the deceased is buried in these graves, soil is not thrown over him, but they are closed with brick as well. And if a person disapproves of this practice and is not satisfied with it, but cannot change it, and is therefore buried in these graves, what is your opinion, may Allah preserve you, and does the person commit a sin after what has been mentioned?
The Shaykh : In reality, if the matter is as the questioner mentioned, that the graves are built with brick and raised to about a meter, then these are not graves, but rather built chambers, which may be for one deceased person or for two or more. This is not what is prescribed for graves. What is prescribed for a grave is that a hole is dug in the ground the size of the deceased, and the deceased is buried in it, like this. This was the guidance of the Prophet (peace and blessings be upon him and his family) and his Companions.
Therefore, it is obligatory for the rulers in these lands to return to the correct burial that came in the Sunnah from the Messenger of Allah (peace and blessings be upon him and his family). And if a person dies and has no choice but these graves, which are in reality chambers and not graves, then he commits no sin, because this is not by his choice. Yes, if there is open land where he can say, "Bury me there," and it does not belong to anyone, then perhaps that would be good and better than what this questioner described. Yes.
