Continuation of the discussion on the acts of Hajj.

The Shaykh : So do not be deceived, but if someone says: If you say that the stoning of the pillars is not valid except after the sun passes its zenith, and the pilgrims number five and a half million, how is it possible for these people to stone between the zenith and the setting of the sun? This is difficult, very difficult, because if you divide this number by this time, you will find that one must stone a certain number of people per minute, or something like that? We say: The matter is broad, and praise be to Allah. The matter is broad; it is possible to stone after the setting of the sun until the dawn of the next day. And stoning after sunset, if it is for the performance of the act, is considered performance, because many scholars say that stoning on the days of Tashriq is from the zenith until the dawn of the next day. And if we say that it does not extend into the night and ends with the setting of the sun, we say that stoning after sunset is making up for a missed act. So the pilgrim was unable to stone in the time of performance, so let him stone in the time of making it up, and the matter is broad, and praise be to Allah.
If someone says: The day follows the night, and if you say that you stone on the eleventh day in the night of the twelfth, you have made the night follow the day, whereas the day follows the night? We say: There is nothing strange in that. Do not the people stand at 'Arafah from the zenith until the rising of the sun on the Day of Sacrifice? So the night of the Day of Sacrifice is now following the ninth day, and it is the night of the tenth, so there is nothing strange in this.
Now, so what do we do on the eleventh day? We stone the pillars how many? The three, in the order you heard: the first, then the middle, then the large pillar.
On the night of the twelfth: The pilgrims spend the night in Mina, and you know that spending the night in Mina is obligatory, and that it is not permissible to be negligent in it. And on the twelfth day, we stone the pillars as we stoned them on the eleventh day. Then whoever wants to hasten, let him leave Mina, and whoever wants to delay, let him stay, because Allah has given a choice, so He said:
Then whoever hastens [his departure] in two days - there is no sin upon him; and whoever delays [until the third] - there is no sin upon him - for him who fears Allah
[Al-Baqarah 2:203]
.
And which is better? Delaying is better, because Allah praised those who delay, so He said:
and whoever delays [until the third] - there is no sin upon him - for him who fears Allah
[Al-Baqarah 2:203]
And because the Prophet (peace and blessings be upon him) delayed, and following his example is better, and because in delaying there is an increase in righteous deeds, such as spending the night and stoning the pillars.
When Hajj is finished and a person wants to return to his country, he must perform the farewell circumambulation without walking between al-Safa and al-Marwah and without being in the consecrated state of pilgrimage, seven circuits, then he leaves immediately to his country, and the farewell circumambulation must be the last thing. Accordingly, whoever performs the farewell circumambulation and then goes out and stones and walks from Mina, his circumambulation is not in its proper place, and it is as if he did not circumambulate, due to the saying of the Prophet (peace and blessings be upon him):
He who did any act for which there is no sanction from our behalf, that is to be rejected.
Sahih Muslim 1718b
And he was commanded that the farewell circumambulation be the last thing.
And the farewell circumambulation is dropped for the menstruating woman and the woman with post-natal bleeding, because when it was said to the Prophet (peace and blessings be upon him):
Indeed, Safiyyah had performed the circumambulation of 'Id and she was menstruating. He said: Let her leave.
meaning: and there is no farewell for her, and due to the hadith of 'Abdullah ibn 'Abbas (may Allah be pleased with them both):
The people were ordered to perform the Tawaf of the Ka`ba (Tawaf-al-Wada`) as the lastly thing, before leaving (Mecca), except the menstruating women who were excused.
Sahih al-Bukhari 1755
The scholars (may Allah have mercy on them) said: If one delays the circumambulation of 'Id, which is on the day of 'Id, and performs it when traveling, it suffices for him for the farewell circumambulation. Did you understand? Just as the obligatory prayer suffices for the greeting of the mosque, meaning: if you enter the mosque and pray the obligatory prayer of four, two, or three rak'ahs, it suffices for you for the greeting of the mosque. Likewise, the circumambulation of 'Id is obligatory, and it is more emphasized than the farewell circumambulation. If you perform it when traveling, it suffices for you for the farewell circumambulation. But what do you intend?
We say: The intention here has three forms: Either he intends the farewell circumambulation alone. Or the circumambulation of 'Id alone. Or he intends both of them together.
If he intends the farewell circumambulation alone, it does not suffice for the circumambulation of 'Id, because the lower does not suffice for the higher. And I have mentioned to you that the circumambulation of 'Id is higher than the circumambulation of what? The farewell, as evidenced by the fact that the farewell circumambulation is dropped for the menstruating woman, while the circumambulation of 'Id is not dropped.
And if he intends the circumambulation of 'Id alone, what? It suffices for the farewell circumambulation. And if he intends both of them together, he gets both of them, due to the saying of the Prophet (peace and blessings be upon him and his family):
The reward of deeds depends upon the intentions and every person will get the reward according to what he has intended.
Sahih al-Bukhari 1
