If a person prays the rawatib of Maghrib and one of the latecomers joins him and prays with him considering it the Maghrib prayer, is it permissible for the one performing the voluntary prayer to recite aloud, and is it permissible for the one performing the obligatory prayer to pray behind the one performing the voluntary prayer?

The questioner : Your Eminence, if a person is performing the rawatib of Maghrib and another person enters, sees him performing the rawatib, and joins him considering it the obligatory prayer, is it prescribed for him to do so? Does the imam recite aloud? Is the recitation aloud prescribed, and is the congregation prescribed, being a recommended practice of rawatib?

The Shaykh : As for the opinion of those who hold that it is not permissible for the one performing the voluntary prayer to lead the one performing the obligatory prayer, it is not permissible for him to join him, because if he joins him, his prayer is invalid. As for the stronger opinion, which holds that it is permissible for the imam to be performing a voluntary prayer while the ma'mum is performing an obligatory prayer, there is no harm in joining him. In that case, he should recite aloud in order to attain the recommended practice for his brother who joined him. If he recites quietly, there is no blame on him. Yes.
