The questioner : A man who owns a date palm orchard and has not paid zakah on what comes out of it for a period of fifteen years, and he does not know whether it reached the nisab or not. He says it approximately reached the nisab or was close to it, but he does not know exactly. He used to give from the date palms approximately half of them with the intention of charity, but he did not intend it as zakah! So what is required of him?

The Shaykh : He owes nothing, as long as the man does not know that it reached the nisab, he owes nothing, because one of the conditions for the obligation of zakah is reaching the nisab.
