Benefits of the Hadith: (… Aisha said: I applied perfume to the Prophet (peace and blessings be upon him) with my hands for his ihram, and I applied perfume to him at Mina before he proceeded)

Machine translationRead the Arabic original
The Shaykh : In this is evidence of the Prophet’s (peace and blessings be upon him) love of perfume, because he made it one of the last things he touched, as he touched it when entering ihram before being prohibited from it. Then, as soon as he performed the first removal of ihram, he hastened to apply perfume before circumambulating the House on the day of the festival.
It also indicates that the second removal of ihram does not occur except after the stoning and the shaving, specifically after stoning the Jamarat al-Aqabah on the day of the festival and shaving. This is the correct and stronger opinion, even though some scholars said that the first removal of ihram occurs after stoning the Jamarat al-Aqabah on the day of the festival. However, the correct view is what this hadith indicates, and what came in some wordings of the referenced hadith:
When you have stoned and shaved, everything is permitted to you except women إذا رميتم وحلقتم فقد حل لكم كل شيء إلا النساء
Sunan al-Bayhaqi 4:929
, and because that is more cautious and more purifying for the conscience, the opinion that there is no removal of ihram except after the stoning and the shaving is preferred for three reasons:
First, it has been reported in some wordings of the hadith:
When you have stoned and shaved إذا رميتم وحلقتم
.
The second is that the apparent meaning of Aisha’s hadith is that he did not remove his ihram except before the circumambulation. If he had removed his ihram, she would have said: “And he removed his ihram before he shaved.” She did not say: “for his removal of ihram before he circumambulated”. It is known that there is no removal of ihram except after the stoning and the shaving.
The third reason is that it is more cautious and more purifying for the conscience. So, saying to a person, “Do not wear [permissible clothing] and do not apply perfume until you shave after the stoning,” is undoubtedly more cautious and more appropriate.
How does the first removal of ihram differ from the second removal of ihram? It is that he becomes permitted everything except women. So, when he is permitted everything except women, he has reached the state of the first removal of ihram. When he performs the second removal of ihram, everything becomes permitted to him.
Here is an issue: A man married a woman who had performed the Tawaf al-Ifadah, but she was menstruating. She was too shy to inform her family, then she returned to her hometown and got married. What is the ruling on the marriage?
The student: Not correct.

The Shaykh : The marriage is invalid and not valid. Why?

The questioner : ... .

The Shaykh : Because she is still in the remainder of her ihram, as she had only performed the first removal of ihram. Accordingly, she must go to Mecca and perform an Umrah, circumambulate the Tawaf al-Ifadah, and the marriage contract must be renewed because it was not valid.

The questioner : ... .

The Shaykh : Yes, so in such an issue, a student of knowledge should accustom himself to applying real-life situations to the rulings he knows, because a student of knowledge’s ability to apply real-life situations is very important. For this reason, the pharmacist knows the medicine, but who knows how to use it?

The questioner : ... .

The Shaykh : The doctor. If you know this medicine and know its properties and the diseases for which it is a remedy, but you do not know how to apply it, you have destroyed people. This is what harms many students now, especially those who do not study under the scholars; they do not know how to apply the rulings to the issues, so you find them making many mistakes and mixing things up, leading themselves and others astray without knowledge. So I always love for you to accustom yourselves to application, even by posing issues among yourselves in research and discussion; you pose issues and apply them to the knowledge you have, so that you practice knowing how to apply real-life situations to the Islamic legal rulings. Yes. Ahmad?
