And do not approach unlawful sexual intercourse. Indeed, it is ever an immorality and is evil as a way. ولا تقربوا الزنا إنه كان فاحشة وسآء سبيلا
[Al-Isra 17:32]

The Shaykh : Regarding zina, the scholars say it is the act of committing an immorality in the front or the back. This is zina: committing an immorality in the front or the back, meaning having intercourse with one with whom intercourse is not lawful. This is zina.
And His saying, the Exalted:
And they do not commit unlawful sexual intercourse ولا يزنون
This is among the descriptions of the slaves of Allah whom Allah the Exalted mentioned at the end of Surat al-Furqan.
And His saying:
And do not approach unlawful sexual intercourse. Indeed, it is ever an immorality and is evil as a way. ولا تقربوا الزنا إنه كان فاحشة وساء سبيلا
[Al-Isra 17:32]
It is an immorality in itself, and it is a bad method and a path in which the doer walks.
And reflect here: He said regarding zina:
Indeed, it is ever an immorality and is evil as a way. إنه كان فاحشة وساء سبيلا
[Al-Isra 17:32]
, and regarding marrying the wives of one’s fathers He said:
And do not marry those [women] whom your fathers married, except what has already occurred. Indeed, it was an immorality and hateful [to Allah] and was evil as a way. ولا تنكحوا ما نكح آباؤكم من النساء إلا ما قد سلق إنه كان فاحشة ومقتا وساء سبيلا
[An-Nisa 4:22]
, and regarding sodomy, Lut said to his people:
Do you approach the shameful act? أتأتون الفاحشة
So these are three expressions.
As for His saying:
Indeed, it was an immorality إنه كان فاحشة
[An-Nisa 4:22]
, it is the lowest of them, meaning a grave sin among the grave sins. As for His saying:
The immorality. الفاحشة
, which contains
Al- أل
, it is evidence that this act reached the utmost degree of obscenity, may Allah protect us, the greatest obscenity. As for His saying:
Indeed, it was an immorality and hateful إنه كان فاحشة ومقتا
[An-Nisa 4:22]
, yes, it was a grave sin among the grave sins, but it added to this hatred, and intense hatred. This indicates that marrying those who are prohibited to marry is more abhorrent than unlawful sexual intercourse.
For this reason, many scholars held that zina with those with whom marriage is forbidden is a cause for execution absolutely, whether the adulterer is a virgin or not, because it is greater. Indeed, the private parts of those with whom marriage is forbidden are not lawful in any circumstance, whereas zina with those other than those with whom marriage is forbidden is zina with a private part that may be made lawful by what?
By the contract, by a valid marriage contract. So that became uglier and more heinous.
