Benefits of the Hadith: (… One does not marry a woman and her paternal aunt, nor a woman and her maternal aunt).

Machine translationRead the Arabic original
The Shaykh : And whoever it is, this hadith indicates that one does not marry a woman and her paternal aunt, nor a woman and her maternal aunt. Adding this to the noble verse
and that you take [in marriage] two sisters simultaneously, except for what has already occurred وان تجمعوا بين الأختين إلا ما قد سلف
[An-Nisa 4:23]
, the women between whom marriage is forbidden are three: the sisters, the woman and her paternal aunt, and the woman and her maternal aunt. This explanation is clearer than the connection mentioned by some scholars, who said that it is forbidden to marry two women if it is possible that one is male and the other female, such that it is not permissible to marry her because of kinship or breastfeeding, excluding in-laws. This is actually complicated; understanding it is difficult, but the verse and the hadith are very clear.
One should not combine a woman and her father's sister, nor a woman and her mother's sister in marriage. لا يجمع بين المرأة وعمتها ولا بين المرأة وخالتها
Sahih Muslim 1408a
And in the noble Qur'an
and that you take [in marriage] two sisters simultaneously وأن تجمعوا بين الأختين
[An-Nisa 4:23]
these are three, very clear. Now, what about a woman and her cousin? Is it permissible? How? A woman and her cousin? Is it permissible? What is the evidence?
The student: … There is no evidence …

The Shaykh : They are not sisters, nor an aunt and an aunt, yes. Now, what about a woman and her father’s wife?
The student: It is not permissible.

The Shaykh : A woman and her father’s wife. Is it the case that people say the daughter calls her father’s wife "aunt"?
The student: It has no legal standing.

The Shaykh : It is not permissible?
The student: It has no legal standing.

The Shaykh : It has no legal standing. So, it is permissible for a man to marry his wife’s daughter from another man. Now, what about a woman and her daughter? Marriage is not permissible, nor is cohabitation without marriage? Is this a permanent prohibition? If a man marries a woman, her mother is forbidden to him, and her daughter is forbidden to him if he has consummated the marriage. Now, what about two sisters through breastfeeding?
The student: There is a difference of opinion, there is a difference of opinion.

The Shaykh : It is not permissible, it is not permissible, because Allah said
and that you take [in marriage] two sisters simultaneously وأن تجمعوا بين الأختين
[An-Nisa 4:23]
Then the Prophet (peace and blessings be upon him) said
Breast-feeding makes unlawful (for marriages) the same things that blood tie make unlawful. يحرم من الرضاع ما يحرم من النسب
Sunan Ibn Majah 1937Sahih (Darussalam)
So, if marrying two sisters through blood relation is forbidden, then marrying two sisters through breastfeeding is forbidden. This is contrary to the view of Shaykh al-Islam Ibn Taymiyyah (may Allah have mercy on him) in this issue. Shaykh al-Islam (may Allah have mercy on him) says in this issue that it is permissible to marry two sisters through breastfeeding, considering the cause. He says that the cause for the prohibition of marrying two sisters, or a woman and her paternal aunt, or a woman and her maternal aunt, is the fear of severing ties. Breastfeeding does not involve a bond that requires maintaining ties. So, he says that as long as this is the cause, it is not forbidden. But what do we say about the saying of the Messenger (peace and blessings be upon him)
Breast-feeding makes unlawful (for marriages) the same things that blood tie make unlawful. يحرم من الرضاع ما يحرم من النسب
Sunan Ibn Majah 1937Sahih (Darussalam)
These two sisters, if they are related by blood, marrying them is forbidden, and if they are related by breastfeeding, marrying them is forbidden.
