Question: A reader from Makkah al-Mukarramah asks: Is it permissible for a man to marry the daughter of his wife’s brother?

Answer: It is not permissible for a man to marry the daughter of his wife’s brother if her aunt is in his marriage bond, nor is it permissible for him to marry the daughter of his wife’s sister if her mother’s sister is in his marriage bond; because the Prophet (peace and blessings be upon him) said:
forbid two types of marriage: For a man to be married to a woman and her paternal aunt (at the same time), and to a woman and her maternal aunt( at the same time).نهى أن يجمع الرجل بين المرأة وعمتها، وبين المرأة وخالتها

The scholars (may Allah have mercy on them) have reached consensus on the prohibition of this due to this authentic hadith. However, if the aunt or the mother’s sister has died, or if he divorced her and she has completed her waiting period, then there is nothing wrong with him marrying her brother’s daughter or her sister’s daughter; because the combination does not exist in that case.
