The questioner : This letter reached us from the land of Zahran, Jarad Bani 'Ali. Its sender, your brother M. S. al-Zahrani, says in this letter: Is the farewell tawaf obligatory for the one performing 'Umrah if he stays overnight in Makkah, or is it only obligatory for those performing Hajj?

The Shaykh : The scholars have differed on this issue. Some of them say that the one performing 'Umrah is not required to perform the farewell tawaf, because the Prophet (peace and blessings be upon him) addressed the people during the Farewell Pilgrimage and said:
No one should depart until his last act is at the House. لا ينفر أحد حتى يكون ءاخر عهده بالبيت

He addressed them while they were performing Hajj, and he did not address them regarding this during 'Umrah when they performed the 'Umrah of al-Qada. This indicates that it is obligatory only in Hajj.

The Shaykh : Others among the scholars said that the farewell tawaf is obligatory for both the one performing Hajj and the one performing 'Umrah, due to the generality of the Prophet's (peace and blessings be upon him) statement:

The fact that the Messenger of Allah (peace and blessings be upon him) did not mention it during the 'Umrah of al-Qada does not preclude its obligation, because this is something whose obligation was newly established, so it did not become obligatory until the Farewell Pilgrimage. Also, 'Umrah is called the lesser Hajj, referred to as Hajj by way of predominance and by way of metaphor, because it includes tawaf and sa'y. Furthermore, since this man entered with 'Umrah and began with the tawaf of arrival, it should be concluded with the tawaf of farewell.

The Shaykh : Also, the Prophet (peace and blessings be upon him) placed 'Umrah on the same level as Hajj regarding the obligation of entering the state of ihram from the miqat for one who intends it. So likewise, it should be like Hajj upon departure. Also, al-Tirmidhi narrated a hadith from the Prophet (peace and blessings be upon him).

The questioner : O Allah, send blessings and peace upon him.

The Shaykh : In its chain is al-Hajjaj ibn Artat, in which he ordered that whoever performs Hajj or 'Umrah should not leave until he performs tawaf around the House. Also, the farewell tawaf for 'Umrah is more cautious and clears the conscience. Therefore, we see that it is obligatory for the one performing 'Umrah to perform the farewell tawaf when he leaves, unless he leaves immediately after completing his 'Umrah. In that case, he is not required to perform the farewell tawaf. That is, if he came to Makkah performing 'Umrah, performed tawaf and sa'y, and shaved or shortened his hair, then left immediately, he is not required to perform the farewell tawaf at that time, because the tawaf around the House has already taken place.
