The questioner : This is a letter we received from one of our noble listeners, in which he asks about matters concerning Hajj. He states that in a certain year he performed Hajj to the Sacred House of Allah, but he stayed overnight before reaching the Holy City of Makkah and had intercourse with his wife. What are the consequences in detail? He states that in a past year he performed Hajj to the Sacred House of Allah.
The Shaykh : Yes.
The questioner : But after entering the state of ihram and before reaching the Holy City of Makkah, he and his wife stayed overnight and had intercourse. What are the consequences in detail? He states that he slaughtered a sheep last year, and since he has intended, or intends, to perform Hajj this year, he hopes to be clear about his situation.
The Shaykh : We say: If you were ignorant that this act is forbidden, you and your wife, then nothing is required of you, and your Hajj is valid, and there is no expiation. If you and your wife knew that this is forbidden, then the type of Hajj in which the intercourse occurred is invalid. If you were performing Tamattu', then your 'Umrah is invalid, and it is obligatory for you both to make it up. If you were performing Ifrad or Qiran, then your Hajj is invalid. The implication is that you proceeded with the Hajj and completed it. Therefore, it is obligatory for you both to repeat this Hajj this year. It is obligatory for each of you to pay an expiation, which is a camel that each of you slaughters, and you distribute it as charity to the poor in the Haram or in the place where this violation occurred on your part.
The questioner : Yes.
The Shaykh : Yes, and Allah knows best.
The questioner : May Allah reward you.
Ladies and gentlemen, we have reached the end of this session, in which we reviewed letters from our noble listeners: Salim Ba'amar, N.M.N., 'Aqil Musa, Muhammad Salama from Abha, from al-Mujaddarah, and Sa'dun Rajil al-Humaid from the Northern Region.
We presented these questions and inquiries to Shaykh Muhammad ibn Salih al-'Uthaymeen, professor at Imam Muhammad ibn Saud Islamic University, and imam and preacher of the Great Mosque in the city of 'Unayzah.
Thank you to Shaykh Muhammad, and thank you, ladies and gentlemen, for your follow-up. Peace be upon you, and the mercy of Allah and His blessings.
