The student: When her husband died, the heir would take her and marry her, or detain her to marry her to his cousins or the like.

The Shaykh : His saying:
And do not make difficulties for them in order to take [back] part of what you gave them ولا تعضلوهن لتذهبوا ببعض ما آتيتموهن
[An-Nisa 4:19]
What is the meaning of the verse?
The student: He tightens things for her so he can take what he gave her.

The Shaykh : What is the meaning of oppression (‘adhl)?
The student: It means do not prevent them from their rights.

The Shaykh : Oppression means prevention. Do not oppress them in their rights by tightening things for them so that they ransom themselves with money. What is meant by the clear lewdness?
The student: It includes what came before it.

The Shaykh : So it combines bad treatment and fornication from the bad treatment, because it is betrayal of the husband. His saying:
and live with them in kindness وعاشروهن بالمعروف
What is the meaning of
live with them عاشروهن
? Exchange good treatment between the spouses, and the companionship and association and comparison means exchange with them good treatment in the known manner.

The Shaykh : What is meant by the known manner (ma’ruf)?
The student: The known manner is what the Shari’ah has recognized.

The Shaykh : What the Shari’ah has recognized and approved, and also what custom has recognized, unless it contradicts the Shari’ah.

The Shaykh : We passed over the fact that it is permissible for a person to dislike a person, even if he is a Muslim. Is this a religious dislike or a natural dislike?
The student: A natural dislike.

The Shaykh : Yes, like a person disliking a type of food. What is the great good that Allah sent in His saying:
perhaps you dislike a thing and Allah makes therein much good. فعسى أن تكرهوا شيئا ويجعل الله فيه خيرا كثيرا
[An-Nisa 4:19]
? Perhaps her husband will dislike her. And Allah made in it, what is the good? Did any of the Salaf mention its type? She will bring him righteous children. We took the benefits. Yes. Is there in the verse what indicates that it is recommended for a person to be patient and not hasten to divorce her? Who knows? The best is that, but is it not permissible to say that the meaning is: If you disliked them and divorced them, perhaps you will dislike something and Allah will make therein much good for the one who divorced? He disliked her and divorced her, and another married her, and she brought him righteous children from the other, and Allah will make much good in it. We passed over a text: the same woman, he divorced her and one married her. His saying, Exalted is He:
perhaps عسى
And perhaps. This indicates that patience with his wife is a cause for Allah to compensate him, because it is from Allah, Exalted is He. But will not someone say: Perhaps you will dislike something and Allah will make therein much good for the woman herself, she marries a man and it is better for her than him? This is not possible. Why? Because Allah is addressing the husband and commanding him to be just.
live with them عاشروهن
This indicates that the one being addressed is the husbands.
if you disliked them فإن كرهتموهن
And do not live with them in the known manner, so be patient. For this reason, we mentioned in the exegesis that the estimation is: If you disliked them, then be patient, perhaps you will dislike something and Allah will make therein much good. We mentioned that the making by Allah, Mighty and Majestic, can be cosmic and can be legislative. Do you have any evidence for this? Yes, the legislative is like His saying, Exalted is He:
Allah has not appointed [such innovations as] bahirah or sa'ibah or wasilah or ham ما جعل الله من بحيرة ولا سائبة ولا وصيلة ولا حام
[Al-Ma'idah 5:103]
If someone said: This making is cosmic? Undoubtedly it is a cosmic making, because the legislative making necessitates the cosmic making. That is, if Allah did not make it cosmically from a lake? No, we say that the legislative making necessitates the cosmic making. Is that not correct? So how is the legislative making without the cosmic making? But this negated it, he said:
then Allah has not made ما جعل الله
[An-Nisa 4:90]
, legislatively. What did Allah not make legislatively? But if someone said to you: What did Allah not make by decree? This is not possible. Why? If it were by decree, they would not have, in the pre-Islamic age of ignorance, the dedicated camels (bahirah), the sacrificial camels (saibah), the dam (ham), and the connected (wasilah), so it is by decree. What is an example of the decree-making? His saying, Exalted is He:
It is He who made for you the night to rest therein and the day, giving sight هو الذي جعل لكم الليل لتسكنوا فيه والنهار مبصرا
[Yunus 10:67]
And His saying, Exalted is He:
(10) And made the night as clothing (11) And made the day for livelihood وجعلنا الليل لباسا وجعلنا النهار معاشا
[An-Naba 78:10-11]
This is a cosmic making. May Allah bless you. What is the difference between the cosmic making and the legislative making? The cosmic making includes what Allah loves and what He does not love, this is one, and it must occur. And the legislative may occur and may not occur, and it is not except in what Allah loves. To Allah, and we negate that it can be disliked by Allah, like
Allah has not appointed [such innovations as] bahirah ما جعل الله من بحيرة
[Al-Ma'idah 5:103]
