﴿ فَاسْأَلُوا أَهْلَ الذِّكْرِ إِن كُنتُمْ لَا تَعْلَمُونَ ﴾

The questioner : He says, “I am asking. I had already married, and we agreed on a bridal gift of one hundred pounds. I paid five hundred pounds, and the remaining five hundred pounds are between us. If there is a divorce between me and her, and she is the one who asked me for the divorce, and she says that she insulted me, or he says that she insulted me, and I was upset at that time, and praise be to Allah, I have now withdrawn [my complaint], and she has now passed away to the mercy of Allah. Now I am asking: does she have any right over me, or did she have no right over me? And to whom do I pay her right, if I have a right owed to her, which is the deferred bridal gift that was mentioned.”

The Shaykh : Yes.

The questioner : Yes.

The Shaykh : We say that if the meaning of his statement: “she insulted me” is that she forgave me and waived my right.

The questioner : No, he says: she insulted me and criticized me, and I was upset at that time, and praise be to Allah, I have withdrawn [my complaint]. It is believed that he divorced her when she insulted him?

The Shaykh : Yes.

The questioner : Yes.

The Shaykh : In any case, if he did not deliver the bridal gift to her during her lifetime, he must deliver it after her death, and it will belong to her heirs after the bequest and the debt.

The questioner : Yes.

The Shaykh : And he is also among the heirs, so he is entitled to half of it if she has no children, and a quarter of it if she has children. The remainder is distributed among her heirs, and this is after the bequest and the debt, as is in the Noble Qur'an.
