The second question of Fatwa number ( 6635 )
Q2: One day I was traveling with one of my relatives, and on the way we bought some items, then we competed over the price. I said, "It is forbidden for me that I am the one who pays." Then I went to buy some items from another place, and when I came back, I found that he had paid and refused to back down from that at all. I hope you will kindly issue a ruling for me in my case, and I thank you greatly. Please note that I am married, and so is he.
A2: If the situation is as described, then if your intention in declaring it forbidden was to prevent your companion from paying, you must pay the expiation for an oath, which is: feeding ten poor people, or clothing them, or freeing a slave. If you cannot find the means to do so, then fast for three days, and it is better if they are consecutive. If, however, you intended by that to divorce your wife if he paid, then one divorce takes effect on her. You may take her back as long as she is in the waiting period, provided that two divorces did not precede this one, or that two divorces did not follow it.
And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
