They said, "Take a mutual oath by Allah that we will kill him by night, he and his family. Then we will say to his executor, 'We did not witness the destruction of his family, and indeed, we are truthful.' " قَالُوا تَقَاسَمُوا بِاللَّهِ لَنُبَيِّتَنَّهُ وَأَهْلَهُ ثُمَّ لَنَقُولَنَّ لِوَلِيِّهِ مَا شَهِدْنَا مَهْلِكَ أَهْلِهِ وَإِنَّا لَصَادِقُونَ
[Surat al-Naml:49].
The following is derived from this noble verse:
First: it is prudence—and prudence can be in good or in evil—for a group to contract and covenant upon the methodology by which they proceed, so that they do not disperse and differ.
They said, "Take a mutual oath by Allah that we will kill him by night قَالُوا تَقَاسَمُوا بِاللَّهِ لَنُبَيِّتَنَّهُ
[An-Naml 27:49]
... Then go, gather first to plan the deed, then to execute it.
From this it is derived: it is prudence for a group to gather and agree upon a covenant that binds them to one another, so that the execution is unified.
This course has continued to be followed until now. You know that the document in which Quraysh agreed to boycott Banu Hashim—was it broken by one man? No, rather, this man who wanted to break it went to so-and-so and so-and-so, and he began gathering people around him until they agreed to break it and prevailed in executing his idea.
So the result is that in these matters, a person should, if he intends to undertake a matter and proceed upon a methodology, have with him people who help him, and he should contract and covenant with them. If it is in good, then it is good; and if it is in evil, then Allah will take charge of them.
Here, did they swear to good or to evil? To evil of the greatest evils.
And in it is evidence for the principle of assassination, due to His saying:
that they would surely ambush him and his family at night لَنُبَيِّتَنَّهُ وَأَهْلَهُ
Because night-ambush is assassination, for assassination means killing by surprise. Therefore, the correct of the statements of the scholars is that there is no choice for the heirs of the blood in the case of assassination, and that the assassin must be killed in all cases, even if they pardon him. This is the school of Malik and the choice of Shaykh al-Islam Ibn Taymiyyah, because one cannot guard against it, and it is corruption in the land. This does not contradict the saying of the Messenger (peace and blessings be upon him):
If a person's relative is killed, he has the choice of two things من قتل له قتيل فهو بخير النظرين

Because his saying:
Whoever has من قتل له
this is from the private rights, whereas the matter of assassination is from the public rights, where a person finds him in safety and kills him.
The student: This is the action of the killer.

The Shaykh : No. The action of the killer is that if he wants to kill the one in whom there is a choice, he comes ... but the important thing is that the victim can guard against that. The victim can guard by fleeing, or guard by defending himself, or the like of that ...
As for coming to him while he is sleeping, for example, or coming to him in his house while he is unaware, this is corruption from which one cannot guard, because if he comes to him while he knows of it, he can guard by fleeing, guard by defending himself, guard with weapons for those around him ... and the like of that.
And our saying that he is upon ... with no one present, is because, as I said, the common case is that he is not killed unless there is no one present. But the discussion is about the victim being caught by surprise; this is killing by assassination. So these people swore to this ugly, shameful deed, but they did not achieve the execution of what they wanted, because they plotted and Allah plotted, and Allah is the best of plotters.
