The questioner : Many of the new houses, such as villas and others, have the bathroom in the same place as the hand-washing sinks. A person may relieve himself in the bathroom and then go out to these sinks and perform wudu' there. Is it permissible to say the takbir and the tashahhud at these sinks, for example?

The Shaykh : Yes, as long as the sinks are outside the place?

The questioner : Outside, but the roof is the same.

The Shaykh : It does not harm.

The questioner : ... Is it separated by a wall?

The Shaykh : It is separated by a partition and a door.

The questioner : Yes.

The Shaykh : So this is one place and that is another.

The questioner : Yes.

The Shaykh : There is no blame on him for that.

The questioner : There is no blame on him for this?

The Shaykh : Yes, here is a matter, and although it was not in the question, I would like to point it out.

The questioner : Yes.

The Shaykh : It is that some people orient the bathrooms toward the qiblah when they sit to relieve themselves. The Prophet (peace and blessings be upon him) said:
let none of you face the Qiblah while defecating, nor while urinating. And do not have your back towards it لا تستقبلوا القبلة بغائط ولا بول ولا تستدبروها
Jami` at-Tirmidhi 8Sahih (Darussalam)
And it is established in the Sahih from the hadith of Ibn 'Umar:
That he saw the Prophet (peace and blessings be upon him) relieving himself facing Sham and turning his back to the Ka'bah. أنه رأى النبي صلى الله عليه وسلم يقضي حاجته مستقبل الشام مستدبر الكعبة
.
And based on this, the first hadith indicates the prohibition of facing the qiblah absolutely, whether in a building or not.

The questioner : Yes.

The Shaykh : And this is what its narrator Abu Ayyub understood, where he said: "So we came to Sham and found toilets that had been built facing the Ka'bah, so we turn away from them and seek forgiveness from Allah" And the second hadith indicates on its surface that turning one's back to the qiblah in a building is not a problem, but some people, as I pointed out before, build them facing the qiblah. Such people must change them so that the qiblah is to their right or left.
