The questioner : He says he owes the expiation for an oath, so is it permissible for me to give charity in its value to ten poor people, five riyals each, for example?
The Shaykh : Allah the Exalted made obligatory in the expiation for an oath one of three things:[Al-Ma'idah 5:89] And Allah Blessed and Exalted is He began with the easiest, usually, for feeding is easier than clothing, and clothing is easier than freeing a slave. Then He, Glorified and Exalted is He, said: [Al-Baqarah 2:196] Therefore, giving out money is not permissible, because Allah the Exalted made obligatory feeding, or clothing, or freeing. Then He said: Muwatta Malik 20:65 So we say: instead of giving each person five dirhams, gather the poor people and prepare food for them, lunch or dinner, and let them eat it. Or give them what is equivalent to approximately two and a half sa' (a dry measure of about 3 kg) of rice by the Prophetic sa', and include with it something to sustain them, such as meat or otherwise, and they prepare it in their homes. Or clothe each of them with what is considered clothing, such as a shirt, trousers, a headscarf, and a cap, according to the custom of people in their clothing. Or free a slave if possible. If you do not do any of that, such that you do not find what to fulfill it with, or you do not find anyone who deserves it, because it may be difficult to find poor people who are eligible for neither clothing nor feeding, as if you were in a wealthy country, then in this case you fast three days, because Allah the Exalted said: [Al-Baqarah 2:196] and the object was omitted, so it includes the one who did not find what to feed, meaning the one who did not find food or clothing, or the one who did not find a place for this food and clothing, which are the poor and the needy. Yes.
