The questioner : His other question asks: Is it permissible to swear by other than Allah (Glorified and Exalted is He)? For I see people swearing by the Ka'bah; I see some people swearing by the Ka'bah, by the Qur'an, and by Muhammad, and when I discuss this with them, they say that Allah (Glorified and Exalted is He) said:
And the sun and its brightness والشمس وضحاها
or they say that He said:
(1) By the night when it covers (2) And [by] the day when it appears والليل إذا يغشى والنهار إذا تجلى
[Al-Layl 92:1-2]
What is the ruling on this?

The Shaykh : Swearing by other than Allah or by one of His attributes is forbidden, and it is a type of shirk (associating partners with Allah). For this reason, the Prophet (peace and blessings be upon him) said:
to swear by your fathers, so whoever has to take an oath, he should swear by Allah or keep quiet. لا تحلفوا بآبائكم، من كان حالفاً فليحلف بالله أو ليصمت
Sahih al-Bukhari 6646
It was also reported from him (peace and blessings be upon him) that he said:
He who swears by anyone or anything other than Allah, has indeed committed an act of Kufr or Shirk من حلف بغير الله فقد كفر أو أشرك
Riyad as-Salihin 1711
And it is established from him that he said:
Whoever among you swears, saying in his oath: 'By Al-Lat! By Al-'Uzza!' Then let him say 'La ilaha illa Allah' من قال: واللات والعزى، فليقل: لا إله إلا الله
Jami` at-Tirmidhi 1545Sahih (Darussalam)
This indicates that swearing by other than Allah is shirk that is purified by the word of sincerity: La ilaha illa Allah (There is no deity but Allah).
Accordingly, it is forbidden for a Muslim to swear by other than Allah (Glorified and Exalted is He), neither by the Ka'bah, nor by the Prophet (peace and blessings be upon him), nor by Jibril, nor by Mikail, nor by a wali (close friend of Allah) among the awliya (close friends of Allah), nor by a caliph among the caliphs of the Muslims, nor by honor, nor by nationality, nor by patriotism. Every oath by other than Allah is forbidden, and it is a type of shirk and kufr (disbelief), may Allah protect us from it. As for swearing by the Qur'an, which is the speech of Allah, there is nothing wrong with it, because the Qur'an is the speech of Allah (Glorified and Exalted is He); Allah spoke with it in reality, with His own wording, intending its meaning. And He (Glorified and Exalted is He) is described as having speech. Therefore, swearing by the Qur'an is swearing by one of the attributes of Allah (Glorified and Exalted is He), and it is permissible.
As for the counter-argument of those you advise against this, citing the saying of the Exalted:
And [by] the night when it covers وَاللَّيْلِ إِذَا يَغْشَى
[Ash-Shams 91:4]
And the sun and its brightness وَالشَّمْسِ وَضُحَاهَا
and the like, this is from the deeds of the people of deviation who follow what is ambiguous in the revelation of Allah (Glorified and Exalted is He) and use it to oppose the clear verses. This oath is one by which our Lord (Glorified and Exalted is He) swore, and it is permissible for Allah the Exalted to swear by whatever He wills of His creations that indicate His greatness and power. And He (Glorified and Exalted is He) has forbidden us, through the tongue of His Messenger (peace and blessings be upon him), to swear by other than Him. So it is upon us to obey the command, and it is not upon us to oppose the command of Allah with what Allah spoke. Indeed, Allah does what He wills. Yes.
