Q: A woman has gold that reaches the nisab, and she did not know that zakah was obligatory on it until about five years had passed while it was with her. When she learned of this, she wanted to pay its zakah, but she has nothing other than this gold. What should she do to pay the zakah for the past five years? Should she sell a portion of it, or what should she do? And how should she handle the coming years, given that if she wants to pay it all at once, she cannot, unless she sells some of it every year; for she has no income, neither little nor much?

A: She must pay the zakah on her jewelry in the future every year if it reaches the nisab, which is twenty mithqals. Its amount in Saudi riyals is eleven and three-sevenths of a riyal, and in grams, it is ninety-two grams. If some of the gold or other of her property is sold, there is no harm if her husband, her father, or someone else pays it on her behalf with her permission; otherwise, the zakah remains a debt in her liability until she pays it.
As for the past years before she knew that zakah was obligatory on jewelry, she owes nothing for them due to her ignorance and the doubt involved in the matter, because some scholars do not consider zakah obligatory on jewelry that is worn or prepared for wearing. However, the stronger position is that zakah is obligatory on it if it reaches the nisab and a lunar year has passed over it, because the evidence from the Book and the Sunnah establishes this. And success is from Allah.
