Question:
The first message in this episode is from one of our brother listeners in Riyadh, who indicated his name with the initials (S. A). Our brother has a set of questions, reaching up to seven, one of which says: I ask your Eminence about the nisab of gold. I have approximately one hundred grams for my wife. Is zakat obligatory on this amount, or is it obligatory only on what exceeds the nisab? And I know that the nisab is eighty-three grams.

Answer:
In the name of Allah, the Most Gracious, the Most Merciful. Praise be to Allah, and may Allah send prayers and blessings upon the Messenger of Allah, and upon his family and his Companions, and upon whoever follows his guidance. As for what follows:
The nisab of gold, as explained by the scholars, is twenty mithqals. The amount of a mithqal in Saudi riyals is eleven riyals and three-sevenths of a riyal; because the riyal is two mithqals minus a quarter, and this is obtained from eleven riyals and three-sevenths, making the total twenty mithqals. The meaning is: eleven and a half riyals; because the small fraction is excused in this case, eleven and a half riyals. This is the nisab of gold in riyals.
As for in grams, the estimators have differed according to their precision regarding the gram. What we issue fatwas with is: that the nisab is ninety-two grams, after we asked many people of expertise about the weight of the gram, and everyone said ninety-two. This is the nisab in grams. So if the gold jewelry reaches this amount; zakat becomes obligatory in it, whether it is bracelets, necklaces, or otherwise that a woman collects. If the total reaches eleven and a half riyals, ninety-two grams; zakat becomes obligatory on her, in all that she has, whether she wears it or does not wear it, or she wears some and stores some. Zakat is due on the whole, according to the correct opinion of the scholars.
And some of the scholars held that if she wears it; there is no zakat in it. The correct view is that there is zakat in it absolutely; due to the generality of his saying (peace and blessings be upon him):
If any owner of gold or silver does not payما من صاحب ذهب، ولا فضة لا يؤدي زكاتها

what is due on him, when the Day of Resurrection would come, plates of fire would be beaten outحقها إلا إذا كان يوم القيامة، صفحت له صفائح من نار

…, the hadith; and because he (peace and blessings be upon him): a woman entered upon him with two bracelets of gold in her hand -meaning: two gold bracelets- and he said:
Do you give the zakah of this?أتعطين زكاة هذا؟
She said: No. He said:
Are you pleased that Allah may put two bangles of fire on your hands?أيسرك أن يسورك الله بهما يوم القيامة سوارين من نار؟

So she threw them down. She said: They are for Allah and His Messenger. Al-Nasa'i (may Allah have mercy on him) and Abu Dawud narrated it with a sound chain, from the hadith of Abdullah ibn Amr ibn al-As, (may Allah be pleased with them both).
And al-Tirmidhi narrated it with another weak chain, but the reliance is on the narration of al-Nasa'i, and Abu Dawud.
And for the hadith of Umm Salama (may Allah be pleased with her) that she said: O Messenger of Allah -and she was wearing ornaments of gold- is this a treasure? He said (peace and blessings be upon him):
what reaches the amount to be paid zakat on, and is paid, is not a treasureما بلغ أن يزكى فزكي؛ فليس بكنز
He did not say to her: there is no zakat in it; because it is jewelry, but he said:
what reaches the amount to be paid zakat onما بلغ أن يزكى
meaning if it reaches the nisab
and is paid, is not a treasureفزكي فليس بكنز

Meaning, and as for what is not paid zakat on; it is called: a treasure, meaning: its owner is punished with it, even if it is jewelry. And the Prophet (peace and blessings be upon him) refers by this to His saying (Exalted and Majestic is He) in Surat al-Tawbah:
And those who hoard gold and silver and spend it not in the way of Allah - give them tidings of a painful punishment.وَالَّذِينَ يَكْنِزُونَ الذَّهَبَ وَالْفِضَّةَ وَلا يُنفِقُونَهَا فِي سَبِيلِ اللَّهِ فَبَشِّرْهُمْ بِعَذَابٍ أَلِيمٍ
[al-Tawbah:34], so the treasure is what is not paid zakat on, even if it is on the surface of the earth, even if it is in boxes, even if it is in banks; it is called: a treasure. And what is paid zakat on; is not a treasure, even if it is in the belly of the earth, it is not called a treasure, and that is when its right is fulfilled.
As for the hadith that he (peace and blessings be upon him) said:
There is no zakah on jewelryليس في الحلي زكاة

it is a weak hadith according to the scholars, it is not valid to rely on it.
And the zakat is a quarter of a tenth in the hundred, two and a half, and in the thousand twenty-five, and so on, a quarter of a tenth every year. So if it is less than the nisab; nothing is required of him. And if what is present is a nisab, or more, a quarter of a tenth is due on it, two and a half from the hundred, twenty-five from the thousand, and so on. Yes.
