Question: The brother / S. A. S. from al-Dhahrān in the Kingdom of Saudi Arabia says in his question: I am a resident and I wish to perform the 'Umrah of Ramadan for myself and for my deceased father. Is it permissible for me to go to the miqat and intend the 'Umrah for my father, and then, after performing the rites, to enter the state of ihram from my location, whether in Makkah or Jeddah, for an 'Umrah for myself, or is it necessary to go to the miqat?

Answer : If you are outside the miqats and you wish to perform Hajj or 'Umrah for yourself or for someone else, whether a deceased person or one unable to perform it due to old age or an illness that is not expected to end,
then it is obligatory for you to enter the state of ihram from the miqat you pass through while intending Hajj or 'Umrah. Once you have finished the rites of 'Umrah or Hajj, there is no blame on you if you perform an 'Umrah for yourself from the nearest part of al-Hal, such as al-Tan'īm, al-Ja'ranah, or similar places. You are not required to return to the miqat, because 'A'ishah (may Allah be pleased with her) entered the state of ihram for 'Umrah from the miqat of Madinah with the Prophet (peace and blessings be upon him) during the Farewell Pilgrimage. When she had finished her Hajj and 'Umrah, she sought the Prophet's (peace and blessings be upon him) permission to perform a separate 'Umrah. He ordered her brother 'Abd al-Rahman to take her to al-Tan'īm, so she performed 'Umrah after the Hajj, and he did not order her to return to the miqat. She had combined her Hajj with the 'Umrah for which she had entered the state of ihram from the miqat, by the command of the Prophet (peace and blessings be upon him), when she menstruated before completing her rites.
However, if you are a resident inside the miqats, such as Jeddah, al-Buqay'ah, or similar places, it is sufficient for you to enter the state of ihram for 'Umrah or Hajj from your home, and you are not required to go to the miqat. This is because when the Prophet (peace and blessings be upon him) designated the miqats, he said:
and those (Mawaqit) are also meant for those who live at these (places) and for those too who come from without towards them for the sake of Hajj or 'Umraهن لهن ولمن أتى عليهن من غير أهلهن ممن أراد الحج والعمرة

, and then he said:
and whoever is living within these boundaries can assume lhram from the place he starts, and the people of Mecca can assume Ihram from Mecca.ومن كان دون ذلك فمن حيث أنشأ حتى أهل مكة يهلون من مكة

, agreed upon by al-Bukhari and Muslim from the hadith of Ibn 'Abbas (may Allah be pleased with him).
And the hadith of 'A'ishah (may Allah be pleased with her) mentioned above indicates that one who is inside the Haram is not permitted to enter the state of ihram from inside the Haram specifically for 'Umrah. Rather, he must go out to al-Hal and enter the state of ihram from there for 'Umrah, as the Prophet (peace and blessings be upon him) ordered 'A'ishah to do. The hadith of 'A'ishah mentioned serves as a specification for his (peace and blessings be upon him) statement in the hadith of Ibn 'Abbas:
or in the suburbs of Mecca or within Mecca, they should enter upon the state of Ihram at these very places.حتى أهل مكة يهلون من مكة
