Q7: Where is the miqat for a resident of Makkah performing 'Umrah?
Vol. 7 : The miqat for 'Umrah for one in Makkah is the non-sacred area (al-hal); because 'A'ishah (may Allah be pleased with her), when she insisted upon the Prophet (peace and blessings be upon him) that she perform a separate 'Umrah after having performed Hajj with him as a combined pilgrimage, ordered her brother 'Abd al-Rahman to go with her to al-Tan'eem so that she could enter the state of ihram from there for 'Umrah, which is the closest point of the non-sacred area to Makkah , and that was at night. If entering ihram for 'Umrah from Makkah or from any place in the Haram had been permissible, the Prophet (peace and blessings be upon him) would not have made it difficult for himself and for 'A'ishah and her brother by ordering her brother to go with her to al-Tan'eem to enter ihram from there for 'Umrah, and that was at night while they were traveling, and it would have required him to wait for them, and to allow her to enter ihram from her residence with him in the flat area of Makkah (Batha') , in accordance with the leniency of the Shari'ah
and its ease; and because he was never given a choice between two matters except that he chose the easier of them, as long as it was not a sin, and if it was a sin, he was the farthest of people from it. And since he did not allow her to enter ihram for 'Umrah from the flat area of Makkah (Batha') , that indicates that the Haram is not a miqat for entering ihram for 'Umrah. And this was a specification of the hadith:
The Messenger of Allah (peace and blessings be upon him) designated Dhul-Hulaifah as the miqat for the people of Madinah, al-Juhfah for the people of Sham, Qarn al-Manazil for the people of Najd, and Yalamlam for the people of Yemen. These are for them and for anyone who comes upon them from among those who are not their people, from those who intend to perform Hajj or 'Umrah. And whoever is below that, his miqat is from his home, even the people of Makkah from Makkah.وقت رسول الله صلى الله عليه وسلم لأهل المدينة ذا الحليفة، ولأهل الشام الجحفة، ولأهل نجد قرن المنازل، ولأهل اليمن يلملم، هن لهن ولمن أتى عليهن من غير أهلهن ممن يريد الحج والعمرة، ومن كان دون ذلك فمهله من أهله، حتى أهل مكة من مكة
