The questioner : Fatwa number one thousand, five hundred and twenty-one, dated the nineteenth of the third month of the year one thousand three hundred and ninety-seven. First question: Is zakah obligatory on the gold that a woman uses or lends out? And if it is obligatory, how is it paid?
Answer: Zakah is obligatory on a woman's jewelry that she adorns herself with or lends out, whether it is gold or silver, because this falls under the general evidence of the Book and the Sunnah that indicate the obligation of zakah on gold and silver, such as the saying of Allah the Exalted:
And those who hoard gold and silver and spend it not in the way of Allah - give them tidings of a painful punishment. (35) The Day when it will be heated in the fire of Hell and seared therewith will be their foreheads, their flanks, and their backs, [it will be said], "This is what you hoarded for yourselves, so taste what you used to hoard." وَالَّذِينَ يَكْنِزُونَ الذَّهَبَ وَالْفِضَّةَ وَلاَ يُنْفِقُونَهَا فِي سَبِيلِ اللَّهِ فَبَشِّرْهُمْ بِعَذَابٍ أَلِيمٍ * يَوْمَ يُحْمَى عَلَيْهَا فِي نَارِ جَهَنَّمَ فَتُكْوَى بِهَا جِبَاهُهُمْ وَجُنُوبُهُمْ وَظُهُورُهُمْ هَذَا مَا كَنَزْتُمْ لِأَنْفُسِكُمْ فَذُوقُوا مَا كُنْتُمْ تَكْنِزُونَ
[At-Tawbah 9:34-35]
And what is established from the Prophet (peace and blessings be upon him) is that he said: ما من صاحب ذهب ولا فضة لا يؤدي منها حقّها إلا إذا كان يوم القيامة صُفّحت له صفائح من نار فأحمي عليها في نار جهنم فيكوى بها جنبه وجبهته وظهره كلما.

الشيخ : وجبينه، جبهته عندك؟

السائل : نعم.

الشيخ : جبهته.

السائل : ... .

الشيخ : أي نعم.

السائل : فيكوى بها جنبه وجبهته وظهره كلما بردت أعيدت عليه في يوم كان مقداره خمسين ألف سنة حتـى يقضي الله بين العباد فيرى سبيله إما إلى الجنة وإما إلى النار ، رواه مسلم .
ولما ثبت من حديث عبد الله بن عمرو بن العاص رضي الله عنهما أن امرأة جاءت إلى رسول الله صلى الله عليه وسلم ومعها ابنة لها وفي يـد ابنتهـا مسـكتان غليظتان من ذهب ، فقال لها: أتُعطين زكاة هذا؟ قالت: لا . قال أيُسّرك أن يُسوّرك الله بهما يوم القيامة سوارين من نار؟ قالت فخلعتهما فألقتهما إلى النبي صلى الله عليه وسلم وقالت: هما لله عز وجل ولرسوله .
وصلى الله وسلم على نبينا محمد وأله وصحبه.

There is no owner of gold or silver who does not pay its right, except that on the Day of Resurrection, plates of fire will be made for him, and they will be heated in the Fire of Hell, and he will be branded with them on his flank, his forehead, and his back. The Shaykh: And his forehead, is it his forehead in your text? The questioner: Yes. The Shaykh: His forehead. The questioner: ... . The Shaykh: Yes, that is right. The questioner: He will be branded with them on his flank, his forehead, and his back, and whenever they cool, they will be returned to him, on a Day whose measure is fifty thousand years, until Allah judges between the servants, and he will see his way, either to Paradise or to the Fire. Narrated by Muslim. And what is established from the hadith of 'Abd Allah ibn 'Amr ibn al-'As (may Allah be pleased with them both) is that a woman came to the Messenger of Allah (peace and blessings be upon him) with her daughter, and on her daughter's hand were two thick bracelets of gold. He said to her: Do you pay the zakah of this? She said: No. He said: Would it please you that Allah would make them for you two bracelets of fire on the Day of Resurrection? She said: Then she took them off and threw them to the Prophet (peace and blessings be upon him) and said: They are for Allah the Mighty and Majestic and for His Messenger. And may Allah send prayers and blessings upon our Prophet Muhammad and his family and his Companions.
