"And if he makes the teaching of the Qur'an her mahr, it is not valid"

Machine translationRead the Arabic original
The Shaykh :"And if he makes the teaching of the Qur'an her mahr, it is not valid" If he makes the mahr that he will teach her Surat al-Baqarah, it is not valid. Why? Because the Qur'an is not valid as a price or as a wage. It is not valid to teach the Qur'an for a wage. If teaching the Qur'an for a wage is not valid, then it is not valid to make it a consideration, based on the saying of Allah, Blessed and Exalted is He:
So for whatever you enjoy [of marriage] from them, give them their due compensation فما استمتعم به منهن فآتوهن أجورهن
[An-Nisa 4:24]
And teaching the Qur'an is not valid as a wage, so this is not valid. This is what the author said. However, what Muhammad ibn 'Abd al-Wahhab said indicates permissibility. The man who said, "I do not have even an iron ring," was asked,
Do you have anything from the Qur'an? هل عندك من القرآن شيء ؟
He said, "Yes, such and such a surah." He said,
I have given you her in marriage for the part of the Qur'an which you know زوجتكهما بما معك من القرآن فعلمها
Sunan Abi Dawud 2111Sahih (Al-Albani)
So he taught her. Here, the Prophet (peace and blessings be upon him) made the teaching of the Qur'an the mahr. Is there anyone who can speak after the saying of the Messenger? No. So the correct view is that it is valid to marry her by teaching her something from the Qur'an. If he says generally, "My mahr is that I will teach you the Qur'an," what is obligatory? The entire Qur'an. If he intends a part, he must specify it. What is the answer of the author and those who followed him regarding this hadith I mentioned? They say that the Messenger (peace and blessings be upon him) said,
it will not suffice for anyone (as a sacrifice) after you لن تجزئ عن أحد بعدك مهرا
Sahih Muslim 1961i
This is an explicit text that this ruling is specific to this man. What is the answer of those who say it is permissible? They say that this hadith is not authentic from the Prophet (peace and blessings be upon him). If it is not authentic, we return to the original principle. This is one point. Second, we have an important rule: it is impossible for anyone to be singled out for a specific ruling from the rulings of the Shari'ah by their specific identity; rather, it is by their description. Pay attention: it is impossible for anyone to be singled out for any of the rulings of the Shari'ah by their specific identity, but by their description. Clear? Yes. The lame man is not obligated to fight in the path of Allah because he is lame. And so, everyone who has a lameness that prevents them from fighting is not obligated. The poor man has no zakah on him because he is poor, and so on. But by his specific identity? I say this is permissible for this man specifically? It is impossible, absolutely. Even the Prophet (peace and blessings be upon him) was not singled out for anything by his specific identity, absolutely. Correct. Yes, he is not singled out by his specific identity, but by his description, because he is a Prophet and a Messenger. Because Allah, Mighty and Majestic, has no kinship, favoritism, or in-law relationship with the people—subhan Allah—so it is impossible for any human being to be singled out for a ruling by their specific identity, but by their description. Now, a hadith in the two Sahihs refutes this. It is that the Prophet (peace and blessings be upon him) said on the day of 'Id al-Adha,
Whoever slaughters before the prayer, his sheep is a sheep of meat, and let him slaughter another in its place من ذبح قبل الصلاة فشاته شاة لحم وليذبح بدلها
So Abu Burdah ibn Niyar stood up and said, "O Messenger of Allah, I have a sacrificial animal that I slaughtered before I prayed. I wanted my family to eat meat early, and I do not find anything else except a goat. A goat is from the goats, about four months old, except a kid." He said,
Slaughter it, and it will not be valid for anyone after you اذبح ولا تجزئ عن أحد بعدك
Sunan ad-Darimi 6:18
This is a specific exception. So slaughter the kid. And the kid is not valid for the sacrifice because it has not reached the age, and it will not be valid for anyone after you. So how do you say that it is impossible for anyone to be singled out in a ruling from the rulings of Allah by their specific identity, when the Messenger singled out? We said: Al-Bahr and Al-Hibr, Shaykh al-Islam Ibn Taymiyyah, answered that. He said: "The 'after' (ba'd) can be in terms of time, and it can be in terms of state. The 'after' here is in terms of state, like when you say 'nothing after this state,' and the like. So the 'after' here is 'after' in terms of state. That means, if a person like this man is found, ignorant, and slaughters before the prayer, and he has nothing but a kid, we say: slaughter it, as the Prophet (peace and blessings be upon him) said to Abu Burdah ibn Niyar. And what the Shaykh (may Allah have mercy on him) said is the truth, because it is impossible for Allah, Mighty and Exalted, in His richness over everyone, to single out one of the creation by their specific identity for a ruling from the rulings, absolutely. On this, we return to... And if this is the truth, it is very important. This is dearer to me than all mahr: that you know that there is no ruling in the Shari'ah in which anyone is singled out by their specific identity, but there must be a description. And this rule is very important; by it, the wisdom of Allah, Mighty and Exalted, is known, and that the rulings and laws of Allah are tied to descriptions, not to individuals.
