The Shaykh : In the name of Allah, the Most Gracious, the Most Merciful:
The author (may Allah have mercy on him) said, regarding what was quoted from Mu'awiyah ibn Haydah (may Allah be pleased with him), that he asked the Prophet (peace and blessings be upon him): What is the right of one of our wives over him? When the Companions (may Allah be pleased with them) asked the Prophet (peace and blessings be upon him and his family), they asked in order to act, not merely to know, unlike many people today who ask to know and then act only a little. This is because when a person knows what he knows of the Shari'ah of Allah, it becomes an argument for him or against him. If he acts upon it, it is an argument for him on the Day of Resurrection, and if he does not act upon it, it is an argument against him, and he will be held accountable for it.
How often they asked the Prophet (peace and blessings be upon him and his family) about matters of their religion. In the Qur'an there are many questions:
They ask you what they should spend يَسْأَلونَكَ مَاذَا يُنْفِقُونَ
,
And they ask you about orphans وَيَسْأَلونَكَ عَنِ الْيَتَامَى
,
And they ask you about menstruation وَيَسْأَلونَكَ عَنِ الْمَحِيض
,
They ask you about the new moons يَسْأَلونَكَ عَنِ الْأَهِلَّةِ
: all of these are questions by which the Companions (may Allah be pleased with them) wanted to know the ruling of Allah in them and then apply it to themselves and their families.
So Mu'awiyah asked him: What is the right of one of our wives over him? He said:
That you clothe her when you are clothed, and feed her when you eat أن تكسوها إذا اكتسيت، وتطعمها إذا طعمت
: meaning, do not restrict yourself to clothing without her, nor to food without her, but she is your partner. It is obligatory for you to spend on her as you spend on yourself, to the extent that many scholars say: if a man does not spend on his wife and she demands annulment before the judge, the judge has the right to annul the marriage, because he neglected her right which is obligatory for her.
He said:
do not strike her on the face, do not revile her ولا تضرب الوجه ولا تقبح
Sunan Abi Dawud 2142Hasan Sahih (Al-Albani)
: Do not strike her on the face, nor on any other part, except for a reason. We mentioned yesterday that if a man sees defiance and arrogance from his wife, and that she does not fulfill his right, he should first admonish her, then boycott her in the bed, then strike her with a non-harmful strike.
