Question: The husband, his wife, and their son came to me, along with Shaykh D. S. and Prince M. R., who knew all of them. The husband admitted that he had divorced his wife with three pronouncements in a single utterance about a year ago, and that he had not divorced her before that nor after it. His aforementioned wife and her guardian, their son, corroborated his statement.
Answer: Based on this, I issued a fatwa to him that this divorce is considered a single pronouncement, and that he may return to her through a new marriage contract with its conditions that are valid in the Shari'ah; because it is authentically reported from the Prophet (peace and blessings be upon him) in the hadith of Ibn 'Abbas (may Allah be pleased with them both) what indicates this. He asked me to perform the marriage contract between them, and the marriage contract was performed for the aforementioned husband with his aforementioned wife with a mahr of six thousand (6000) riyals, with the conditions that are valid in the Shari'ah. Thus, the aforementioned divorced woman became a lawful wife to the aforementioned divorcer, and she has two remaining pronouncements. Shaykh D. S., Prince M. R., and Shaykh I. 'A. H. testified to all of the above.
This was dictated by the one who is poor before Allah the Exalted, 'Abd al-'Aziz ibn 'Abdullah ibn Baz, may Allah forgive him, and may Allah send prayers and blessings upon our Prophet Muhammad and his family and his Companions.
