Question: I am a young man who wants to marry the daughter of a man, but the problem is that I was breastfed by the man's wife along with his daughter. The daughter who was breastfed with me has passed away, and after that, the man's wife gave birth to a daughter. Is it permissible for me to marry this daughter or not? Please issue a ruling for us, may Allah reward you with good.
Answer: If the wife of the man whose daughter you wish to marry breastfed you five times or more, while you were within the first two years of life, then she becomes your mother through breastfeeding, her husband becomes your father through breastfeeding, and their daughters become your sisters. It is not permissible for you to marry any of them; because of the saying of Allah the Exalted in Surat al-Nisa, when He mentioned the prohibited women: [al-Nisa:23]. And the Prophet (peace and blessings be upon him) said: Sunan Ibn Majah 1937Sahih (Darussalam). It is also established from Aisha (may Allah be pleased with her) that she said: "Among what was revealed in the Qur'an was that ten breastfeedings make marriage prohibited, then this was abrogated by five known breastfeedings. The Prophet (peace and blessings be upon him) passed away while the matter remained as such." Muslim narrated it in his Sahih, and al-Tirmidhi narrated it, and this is his wording. There are other hadiths in this issue.
However, if the breastfeedings were fewer than five, or if you were breastfed after the age of two years, then the aforementioned breastfeeding does not result in prohibition. The woman who breastfed you does not become your mother, her husband does not become your father, and their daughters are not prohibited for you to marry through this breastfeeding—in the most correct opinion of the scholars—based on the aforementioned hadith and other hadiths, including his saying (peace and blessings be upon him):Bulugh al-Maram 8:198, and his saying (peace and blessings be upon him): Sunan Ibn Majah 1940Sahih (Darussalam), in other hadiths mentioned by the scholars.
And success is from Allah.
